I have my EB3-RIR pending at NSC with PD JAN 2004. I-140 concurrently filed on July 23rd 2007 at NSC is still pending. I do have the EAD and AP approved.
I have another EB2 labor (PERM) certified but its I-140 was denied on the basis of qualification. I have 3 yr B.Sc + 2 Yr. Post Graduate Diploma from India. This labor was certified on Dec. 26th 2006 and I-140 was denied last year after replying to the RFE raised regarding qualification. USCIS was looking for 4 yrs. degree instead of 3 yrs. They didn't accept my 2 yrs. post graduate on top of my 3 yrs. B.Sc degree.
My question: Is it advisable to go ahead and revive this PERM labor to file fresh I-140 again? If Yes, then what all I should do before filing the fresh I-140? I have almost 8 years of work experience in USA beside my 3+2 years degree from India.
Please advise.

Looks like this issue is finally getting some attention in both the lobbysphere and in the legislature. I was pleasantly surprised to see this on the yahoo techticker.
It is actually a very sensible partial solution. I hope it will be a part of a multipronged strategy to solve this. I am under no illusion that we alone can solve this, but we can help.
We are already an integral part of this economy but being prevented from contributing fully to it, by purchasing homes and investing into it. It hardly seems a radical approach to integrate us fully by giving green cards if we buy homes. Those who have secure jobs and rare skills are the ones who will buy. Those immigrants will help near and longer term.

As far as I know the country quotas are followed only in the first 3 quarters of the year. Last year a lot of numbers were used for India/China in the June/July fiasco and ROW used less than the yearly quota. India had I think 3 times the yearly quota in those months. So they're trying to use up as much as they can for ROW this year I guess.
I have the same question. State dept moves the date just so that the visa numbers are used for that category. If a category is retrogressed, then it can't really be "undersubscribed".
This was listed at the bottom of the page in the March VB in state dept's website:
The cut-off date movement for March in several Employment categories has been greater than those experienced in recent months. Personally I do not believe that the 7% limit is discrimination. The 7% limit for all countries appears to be equal, it leads to an issue as described below.
2 individuals, one from an oversubscribed country and one from an under subscribed country, leads to their career being affected by where they have been born.
Even though this situation might not be and in all probability is not discrimination, it does lead to conflict certain with certain other government regulations like EEO etc. Which one has precedence? Why?
I don't know the answer to these questions. Nor do I profess any super ability to even make the correct evaluation. But it does present itself to be a moral dilemma. Precisely the situations where the courts might be able to provide guidance (assuming they haven't already)

I hope this is not our last ditch effort or one of the last chips in our possession to further our goals of Greencard.
The crisis in united states is not just housing bubble but much more than that. I am not sure if this initiative (linking greencard and purchasing home) will find much traction in government or in medai given the complexity of the mess.
The currency collapse which we used to discuss is now gathering storm now. The recent runnup in Dollar is peaking now and is in downward trend. Analysts are already up in arms arguing that United states have to take massive debt (assuming China and arab world is ready to give) or they have to print currency to finance their bailouts.

However what we as a community should realize is this is just the first trick under the sleeves of anti-immigrants supported by grassley and co. Once consulting companies are out of the picture, they will target permanent employers with conditions like "the company should not have fired any US citizen in the past 6 months or plan to layoff any citizen in the upcoming 6 months." They could come up with additional restrictions for direct employers as well.

Friends,
Its upsetting to see USCIS playing with our lives. Inviting us to file AOS and then shutting the door on us when we did all the hard work to get here LEGALLY. I remember someone mentioning "GC is a scam". Did'nt USCIS attempt to do that with us? It all about ATTITUDE and at this point I hate USCIS/DOS's attitude towards us (Legal Immigrants) and our families. Starting June 13th, we all would shorten our life-span by 2-5 years due to this tension/excitement.
Well, most people would say US wont be affected even if we relocate in some other country. May be true! But my company keeps loosing work due to not finding the right candidate for the job. So they will of course!
In the long run, if this broken immigration system is not fixed, no business can afford to lose any resources when they know that there is demand in market. Microsoft has found other ways and this is the best example and more companies would soon follow. I hope that this mess gets cleaned soon!

I think this is blown out of proportion.
First thing what exactly "detention" means? Did they tie him up upside down for 2 hrs?
May be they took him to a room, where he waited along with the common man..in India politicians and filmli ones may get to jump the lines and get special treatment..so they never knew what it is like standing in the line.
SRK should use his common sense and keep quiet rather than making a fuss out of nothing..he is not APJ kalam to demand or deserve special treatment.
I remember last year, there was a news about SRK making noise in one of the European airports where he was not allowed to board the flight ahead of others and he argued with airlines staff that "I am SRK".
Note: I am not a fan of SRK..was never and will never be. I am Aamir Khan's fan :)

I am totally convinced with users like jetflyer, kondur_007 and others that �if it goes smooth then next will be EAD, then I-485 approvals�.
At least this is the time to think beyond boundaries (like EB-3, EB-2, working as FT, working with consulting company, states and countries), if not then don�t distract the efforts.

ratturani, i am seeing an increasing number of posts that state the facts as clearly as you have stated... thats great... now i think somewhere some day, someone will float a good idea of motivating employers such as MS, Intel, BAC etc to fight for us instead of trying to motivate only the congress... see, we dont have too much of power in congress... :-(
The earlier people realize it the better it is. GC for non EB 1 - India is over.
Employer will get motivated only when they feel the need. As of now they dont need EB reform as H1B is serving the purpose. Its like chasing a mirage in the desert. My friends who didnt chase GC are the ones doing professionally well. Those who have stayed on the GC boat have seen their careers stagnate and destroyed.
However I have still seen many Indians in US oblivious or ignorant about it including my cousin.

Trust me. I was under the impression that it will be 3-4 years before I see green, but the reality is almost true for me now. Similarly, EB3 folks would get some news by next year. Who knows, the government will change and we have seen how keenly Obama wants a change ;). May be recapturing visas provision will be considered next year and everyone until 2006(EB3) may see some green. We never know. It's all magic and lets hope for the best. :D

I am employed by comp A and have completed 5 yrs on my current H1B. Comp A filed for my I 140 which was approved in Aug 2006. I got a 3 yr extension on that H1B till jul 2010. However, this I 140 was revoked in Jul 2007.
Now I want to do a H1B transfer to comp "B". Can I file for transfer till 2010 July even if the original I 140 is cancelled/revoked? Or am I eligible for only filing for remainder of 1 year?
