This loss of visas is due to:

There is a story: when seeing a bottle filled half with water, optimistic people would say it's "half full", pessimistic people would say it's "half empty". I think this problem is also just people's perspective. Retrogression is still there, it will not be any better or worse with/without the July event. Some people see that retrogression is still there so they are pessimistic, some people see that at least you get something from this even, so they are optimistic.
I see this prediction every now and then. Why don't you guys get your facts straight. Retrogression will remain the SAME. The pace at which they process GC's is not going to change. It's just applications moved from your home queue to the USCIS queue. Why would that make retrogression worse?? Think before you talk!!

How about contacting other already established organisations like ATA, TANA, DTA,BATA, Kannada kutami etc for help? All these organisations are formed by immigrant people from different states in India. They have a huge membership. We can rise funds and memberships by highlighting and explaining our problems. Is there any one pager or document that can be sent to all these orgs and asking them for help in funding as well as political drives?

I called service center..those who have applied to TSC ,they kept all the applications on hold which came on 2 nd July and started to put them into their systems from July 20th ,so just hope to see your check getting cashed by this or next wk...

As I understand, if we win the lawsuit, they will accept all 485 filed in July, no matter July 2 or 31. But they will process July 2 case first.
Based on what exactly ??
Nobody here even comes close in identifying which are the eligibility criteria. Everybody hopes for one or the other.
Meanwhile one thing is for sure:
Every application filed after July 2nd, is filed AFTER they closed the doors oficially! How are we in the same class as the people from July 2nd ??? Just because we prepared for filing ??? Isn't that a bit weak in the eyes of the law ?

If such a bill is implemented we all should knock the doors of judiciary department. Each is department is independent of itself.
Bad for consulting companies (no H1B; may lose job)

Lawmakers will listen to folks who participate in lobby/advocacy activities..apparently H-1B lobby/advocacy is louder than the GC backlog lobby/advocacy and that's what we hear in the news.
Compete America is advocating GC reforms for US educated work force. I am sure most of lawmakers do not know how retrogressed India and china are. Also media is confused too.

Just made my contribution... I am in the middle of applying for LC, not sure if I will be able to eliminate all the applicants but I know so much about the issues for foreign nationals and I am so happy to see some professionals handling our case. I hope this time the bill will pass...

I am probably waiting for the longest here for EAD, my app received on July 2nd at NCS. Called numerous times, sent form 7001, emailed senators twice, 3 infopass appointments, still no progress. I submitted expedite request based on humanitarian grounds last week, have been calling daily to check status of expedite and still remains pending. My case now pending about 157 days. Anything more that I need to do ?

My wife received EAD on 10/22 and so far there has been absolutely no update on my LUD and EAD application is still pending. The service center is Nebraska and I am the primary applicant. I think there a a lot of people in the same boat.

If you say we are paing taxes so we should get greencard. That does not make sense. We are using roads, hospitals, infrastucture of this country and we pay taxes as long we live here.
If you say we invent new things, start Google etc then these people qualify for EB1 and it is always current.
If you say we have USA masters then we can apply in EB2. EB2 will get current next year or its wait time is going to decrease and will be 2 years max. So 2 years or less is a reasonable processing time within a 6 year H1B processing time.
I am playing devils advocate here and trying to tell you to think beyond pleading. We did not come to this country to plead. Once you start thinking negative there are many negatives as I have written above and you will go in depression.
Who is stopping you from Meeting lawmakers? Have you done that?
Who is stopping you from contacting media? Have you done that?
Who is stopping you from contacting your CEO of the company and ask for help? Have you done that.
Who is stopping you from contacting organizations of Indian American citizens and ask for help?
Who is stopping you to do rallies everymonth on weekend in every state. Why are we not doing it if we are so depressed with Greencard.

Do you really agree with multi-national managers(via L1A). This is the area wherein the interpretation is pretty loose. If you dissect EB1 data you would find that EB1C used bulk of it except for this year due to bad economy and tightening of screws. There should be some very clearly defined guidelines for EB1-C, somebody being an onsite coordinator or managing 5 people should not be eligible. This category should be reserved for those who are managing at least 100 people or control business in several millions. I agree that EB1 should be just for the exceptional.

anyway, the focus of this thread was about the president's immigration speech. Atleast the speech included the fact that illegal immigration makes a mockery of legal immigration. understood that any solution also must include finding a way on how to handle the undocumented people.
anyway, the speech for now might be just a start or more "kick in the butt" to let the congress know that they need to start work in CIR. when it comes to fruition is anybody's guess.

Pending Cases Not Included in "Backlog" is 1,316,740 (Fig 1, 2nd column, page 14)
Total Pending = Backlogged + Unripe = 1,275,795 (page 11) + 1,316,740 (Figure 1, page 14) = 2,592,535 (as of March 2007)
So as per USCIS a total of 600,000 applications were pending until June. We can add another 600,000 for july-aug... total now 1.2 Million
Firstly, it is not possible that pending = backlogged + unripe = 600K because there were 2.5M+ pending cases (as explained above) in March 2007. Thus, 600K should be pending EB cases or total backlogged cases.
