I have been US loong enough, to count on False promises. All these indian newspapers dont know what they are publishing, particularly abt things happening in US. Till i see an official announcement from any of the US Government Website i am not counting on this.

O.K. I know it's not the place for this discussion as we need to be optimistic and strong, instead of jumping the ship....
However, after years of wait (which perhaps was not that long compared to many others) and after sobber look at how much longer this may take I start to wonder if it worth it? I am starting to take what used to be a plan B - moving to Canada - more seriously now.
Does any one else have this thoughts or am I the only traitor?

So if I'm understanding it correctly. For all the ones who applied for I-140 after May15th 07 all there petitions will be cancelled or revoked? I really that should come from the USCIS as a amendment and not from a news or a blog. I have been browsing the website and yet to find it. Can someone help me out with the exact text from USCIS? :mad:

Seems like everyone losing hope including core - as someone else said above its really sad to see this. Please dont lose hope at this critical moment else all of our efforts for last two years will go waste.
I cant imagine how much time/effort has been put into this effort by core members (as a relatively inactive member I myself could have easily spent several hundred hours on these forums in last year and half; and atleast some time in calling/faxing etc.). After all these efforts and seeing the current bill its understandable to get deeply disappointed. But dont lose hope yet. Its not over.
Logiclife - coming this from you really shook me. At one point you were so confident that having our measures in any future CIR is but gauranteed - we thought its just a matter of time. All of us were also thinking that we are in a better position to introduce and enact amendments in this congress. We still have time (2 weeks) for amendments - why are we thinking about alternate arrangements and slowly losing hope. Does this show our level of confidence now or this thread is meant for some light hearted fun?

Just because I am taunting the injustice of the bill doesnt mean that I or others have given up. WE ARE in position to put in amendments. How much, I dont know. But pretty sure that we will make a good amount of difference.
But dont let your hopes down because of a sarcastic comment on the bill. Take it as a joke or ignore it.

good point about the H1 quota exempt option. Though remember there is no blanket exemption for doctors...their H1 is cap exempt only if they work for a non-profit institution/university. So it all depends on the employer.
i was in a similar situation about this with a priority date of Jan '06.. i was planning to get married in dec 2009.. but my dates were current and fearing that I might get my GC soon, I rushed to Australia (my fiancee is AUS citizen) and got a registered marriage done... she is still in aus and planning to join me later using following-to-join when i do get gc.. unfortunately, I did not get my GC when the dates were current in Aug or Sep...
but, i dont know how to advice you.. it is a very sticky situation... i think best option is to do H1B, and before that to try and get some visitor visa... my lawyer says there is a 50% chance for one to get H1B if you apply on April 1st.. and almost 0% chance if you apply after April 1st...

Divorce in India takes a minimum 1 year to adjudicate if you were married less than 1 year. Otherwise, it is up to the discretion of the judge. Courts in India require a 'cooling period', with 'counseling / mediation'. Latter is basically a a sham.
That said, as a trained mediator, and negotiator, I would say ... a win-win outcome is always better for all parties. What happens to be 'win-win' is of course subjective.
Good luck in whatever you do! Trust me, things always work out well in the end.
It is very complicated to get divorce in India, if your wife don't file with you. Divorces are valid in India when there is no fraud and agreed by both the parties.

Initially these facilities not provided to CP filers because it used be fast in comparison of 485 filers but now due to this retrogression CP filers are also waiting in queue with 485 filers and not even getting any reliefe I would say they are in very bad situation compare to 485 filers.

As per the data, so far people with notice date (on 485, from NSC) before sept 1st have got their FP notices (except few people). So, I presume if someone's case transfered back to NSC from CSC before spet 1 st, he or she should expect their FP notice soon.
Obviously, we are not going get our notices if there several people lined up with NSC notice dates before our transfer dates.
This is just my logical conclusion, may be incorrect

I really don't understand, what can be RFE about, as you have been with the same company all these years. You really deserve a Greencard straight away without a single question after such a Long wait. I hope your RFE is very simple to answer and I wish that you get your Greencard soon. Good Luck.

But now that they have opened my application and mailed an RFE on Oct 22, at least I know that some IO is processing my case. Right now I am eagerly waiting for the RFE details. I got my GC after 6 years of application and 10 years arrival. Initially the GC was not a goal, probably a mistake.Later on it felt like it was hampering my dreams. With the passage of some more time, realized that dreams were not really dependent on the GC, but it was a nice crutch. Getting the GC does bring about some stability brought about by the job flexibility, but the lack of one did not prevent me from changing jobs, marrying, having kids, buying a home, or searching for better opportunities. I really can't say, I lost a good opportunity because I did not have a GC, but I did use it as an excuse.
Nevertheless, not a look a gift horse in the mouth, the GC was a much awaited event and milestone. I am now officially an immigrant, and I did open a champagne bottle on that day and have a dinner out with the family.

I am exploring the possibility of making the Inter-filing. I have been speaking to some well known, street-smart attornies. One mentioned that the "Priority Date" is decided only upon approval of I-140. He also wrote that for keeping the earlier priority date, the 2nd I-140 application (new) should be filed along with copy of the approval of the first I-140.
In your case, it appears that you did not send the approval copy of the first I-140 along with 2nd I-140 application.
Probably, you can send the approval of EB-2 I-140 with earlier PD, along with I-485 receipt copy to the Service Center and ask them to allot the earlier PD. Please take the assistance of attorney for doing this.

Thats interesting to know that we even pay higher life insurances due to not having a greencard. can someone else second this from their experience. I am not aware of these hardships so if we have to say this in any media interview, we need correct information substantiated by facts.
Forgot to mention. Check those online quote sites. Each one of the companies has a disclaimer that you have to be either a citizen and a PR to qualify. Thanks.

Not sure whether you got a chance to ask the officer about the reason for this visit? Was it a part of random check or any investigation on fund transfers or any other program etc?
Now, I think it is a random check and nothing like 'employer audit'. I never asked him -at that time I thought it was a part of background check.
I believe they are always doing these checks probability could be 1/100,000 although i have no idea at the frequency.
