I am traveling this month end to India via Frankfurt. I am on AP. I checked with German consulate in US and officer told me we need transit visa both ways (going and coming back). there are no exceptions. He confirmed the same twice when I went in person to get Transit visa.
I would rather listen to German consulate office rather than interpreting stupid sentences on German consulate web site. So please do get Transit visa with 2 entries.

I-485s Not Tracked by Priority Date
A question was asked about the volume of employment-based I-485 Application for Adjustment of Status cases pending with NSC as of April 2008. Also asked was how many of the cases had current priority dates. The NSC advised that they had, at that time, approximately 190,000 EB I-485s. They also clarified that they do not track cases solely by priority date. While we are aware that cases were not tracked by priority dates, from the questions we receive, it is worth reiterating to our readers. Our firm see questions, frequently accompanied by outrage, asking why I-485 cases with later priority dates are approved prior to those with earlier priority dates. The answer is simply that the USCIS service centers do not re-sort or track I-485s solely based upon priority dates. Case processing is based upon filing date, but I-485s cannot be approved if the priority date is not current. The NSC also referenced the need for an I-485 to be what they refer to as "viable" in order to be approved. Viable cases are those with approved I-140 petitions, clean fingerprint and name-check results (or name checks pending over 180 days), as well as being eligible for visa issuance, based upon priority date.

We who are stuck in the long waits, it's time for us to rise to the ocassion, attend the rally and untsick ourselves from this, if no one else does it. Only we can free ourselves and get what is only fair! The right to contribute with our skills!

As I said, this was just a hint. Point for discussion in case our amendments do not pass. And there is a precedent which can be used as a leverage. You know the principles of the "brain storm" problem resolution - throw several wild ideas and if at least one of them works, the goal is achieved.

Honorable congressman,
I am writing to you (in your capacity as a judiciary committee member) to bring a recent action by the department of state that wrecked the hopes of many tax paying, employment based legal immigrants.
The New York Times carried an excellent editorial regarding the State department's actions:

As a legal tax paying resident of Masachusetts since 10 long years, I have been eagerly waiting my turn in the line for a green card, putting lot of very important life decisions on hold. This latest bait and switch has made me totally disillusioned with the immigration system and I have started looking for opportunities to apply my skills in my home country instead.
For the sake of fellow legal immigrants who have been impacted though, I am hoping you can look into this matter and try to influence the department of state to correct its action. Rep.Lofgren has already issued a statement in this regard. http://lofgren.house.gov/PRArticle.aspx?NewsID=1808

It is one of the most well written editorials from a renowned source. (You might have to register to see it). Everyone should try to send emails via the above link to their own Senators and Congressman, along with various Congressmen on the House Judicial Committee (Subcommittee on Immigration). http://judiciary.house.gov/committeestructure.aspx?committee=4 .
The House.gov web site does not accept email from anyone outside their respective constituency. The Chairperson is from San Jose CA while the other members are from CA, VA, MA, TX, IL, etc. If you are from one of these places, you need to emphasize the importance to them and also mention that we are the next wealthy voting block of the future elections and we will remember them. Now only a Congressional oversight can save us from the USCIS created crisis.

She may not get a visitor's visa. Visitor's visa requires non-immigration intent, just like F-1. In your case, there is a very clear intent to immigrate, which may disqualify her from getting a visitor's visa.

1. The diversity argument is flawed when it comes to skilled immigration, especially when we have most of the grad schools here filled with Indian/Chinese students. This is what I was explaining to "iskantem" and why especially when you are talking about less than 0.05% of the population it doesn't make sense.
2. We don't even allow anyone over here to have an alternate opinion on an issue. In terms of IV activity, it is almost 100% Indian. However 60% of the EB3 backlog is not from India! Now why don't we see these 70000+ ROW guys participating here I wonder! Let me tell you why. Its because a lot of us actively discourage them from participating whenever they have an opinion contrary to ours (read India). Now I maybe guilty of losing it a little there, but I still made an effort to reach out and explain the flaw in the diversity issue he was mentioning rather than mount an all out attack/ignore him right away/stick my head in the ground.

For couple of weeks in 2001, when I was getting H1 transfer, I was without pay. I applied H1 transfer before old H1 expired, but got the receipt notice after few weeks and only after that I started working. Am I out of status ?
For that matter, is it out of status if one gets paid from 2 companies with
2 H1bs ? If one is on bench but getting paid by one company, starts working with 2nd company on new H1b?

My wife is here in USA and just convert her status from F1 to H4 .And her F1 visa expiring this August. So we r planning to go Canada for Visa stamping.....

I received a soft lud on my H1B approved in Nov 2007. All other cases do not have any LUD. I guess it is just the system touching these records as routine maintainence.

AILA and all the immigration lawyers and many employers threw a hissy fit when DOL wanted to shut down labor substitution.
They lobbied hard at DOL to allow the continuation of labor substitution. IV has tried to get DOL to eliminate labor substitution or at least make it such that the Priority date is not the labor filing date but the 140 filing date. Allow labor sub with PD = 140 filing date will solve the problem of cutting in line and getting ahead in an unfair manner. QGA helped to get our message to Eliane Chow, The Secretary of Labor Department. (http://www.whitehouse.gov/government/chao-bio.html)
Unfortunately, the secretary of labor didnt oblige.
These immig lawyers and AILA bombarded DOL with requests in favor of labor sub.

I don't understand Sheila's position. Until recently (2001), someone with a Bachelors degree could become a CPA since the requirement to take the exam was a certain number of credit hours roughly equivalent to that of a 4-year Bachelors degree. Anyway, I consider a CPA as a certification, not a degree. If USCIS has been accepting CA to be equivalent to a Masters degree, then it is quite generous of them.

hi,
my lawyers filed for AOS (for my wife and me) on july 2nd in NSC. still dont have any reciepts/ead/ap etc. i have no idea why. my i-140 was approved in TSC. i was hoping that i'd get the reciepts since everyone seems to be getting them!

International students come on F1 visa and get instate tuition fee from state universities. Our kids are on H4s so that will not qualify them to attend undergraduate in state schools? Is F1 required to get instate tuition fee? I am not understanding the situation here. Please somebody clarify if possible.
