I guess country quota is root of all our green card related griefs. everybody else can dream of getting a green card someday, but EB-3/EB-2 India & China should stop dreaming about Green cards...I am sure this can be prooved illegal.
Yes true. This is the only angle that is viable in theory. All that can be done is challenge that the per country quota violates the constitution. Then the judge can strike that clause off.
Besides this it needs a law change.

I respectfully disagree, he is the president of USA and to its citizens, you might morally/personally declare him to be your president, but as long as your passport is not from USA you my friend are an alien (not extraterrestrial) living in the US of A :), please dont take this personally I am in the US too, and I got my passport recently renewed, and I had to pledge my allegiance in order to get my passport. My request for help on the following post http://immigrationvoice.org/forum/showthread.php?t=12255 is not going well, I am still waiting to hear from analytical minds.
Anyways, we are in process of creating an eye opener fact sheet that we will be distributed with the promotional fliers. The objective of the fact sheet is create a sense of urgency and draw people's interest to DC rally.
I am looking for ideas as to what to put in the fact sheet, while I am still waiting to hear on my other post.
Please contribute you thoughts. We need to get this completed in couple of days.

EB2 -- Dont run fast, you will fall down again ...
I'm EB3 , with PD Oct 18th, Off by 3 days since last 2 months ...
I don't think dates will go back again unless they drastically move the dates forward. The dates could remain stagnant for a long time though.

Sorry to hear that your 485 is denied....
My question to all the gurus here...I wonder what happens to EAD and AP after you appeal 485 denial?
I know that if your 485 gets denied then EAD and AP are void but lets say OP files 485 MTR(motion to reopen), does he have to reapply for EAD and AP or does that get reinstated based on the reciept he gets on 485 MTR?
Should the person stop working till he gets 485 MTR receipt or till he reapplies for new EAD and gets the approval?
Just curoius to know as these days denials seems to be the trend at USCIS and it would be helpful for all those who rely on EAD only and not sure what to do when there is a 485 denials for what ever reason.
FYI...I am still maintaining my H1 and also have a EAD but plan to switch to EAD only and not renew my H1 this year.
You do NOT have to apply for another EAD. You're safe to go back to work as soon as you receive your MTR receipt. I am sure most people work even while they're waiting for the MTR to be received by uscis though but shhh. I have never heard of a case where the uscis wanted to make sure the person didn't work while they were waiting for their MTR receipt to be sent out. Can you imagine them doing that to someone after their own officer denied the case in error resulting in an individual having to pay 500 bucks to reopen the case? Slap after slap in the face.

People get into these issues and keeps haunting them for years. I know a friend, who has a domestic violence record in 1999 or so and till date cant get a US citizenship because of that. Same with another guy who got a DUI in the 90s. Another guy in 2002, in order to bypass blocked traffic went to the other side (like they do in India often) and paid thousands to a lawyer to deal with the litigation with Police.

1) what is the best way to attach photos when sending supporting docs so that they won't get lost or mis-placed. What goodies are avaialble in Staples for this?

Infopass appt for Interim EAD was not helpful at all.
They suggested the same that I did earlier, ie to fax USCIS hotline about my situation along with letter from emp saying that I am at risk of losing job.
I have done that several times, still no luck.
My EAD expires on aug 30th (yah, just 2 more business days).
Did everything in my hands, now just prepared to lose my job.
Surprising thing is I saw 2 soft LUDs on aug 25th and and 26th but still no approval nor RFE, case status still pending.
I know they are looking at my case, but doing nothing.
My wife's EAD was approved a month ago.
I asked my lawyer (from a big firm) if I will have a case on USCIS in case if I lose my job. She said, USCIS is famous for this kind of processing for 1000's still the cases wont stand against them.
I wld appreciate any suggestions/thoughts?
Efiled @ NSC on may 19th.
FP on july 3rd, still no approval.

2) Called NSC, agent gave a fax number and asked me to provide Emp letter.
Faxed the Emp letter and also a covering letter.
3) 2 weeks passed, still no reply, called up NSC again, explained situation that I wld lose my job if i dont get EAD extension by this month end. She opened a Expedited request and told me to wait for 10 days.
4) As a back up, I also took infopass appoint for next monday (90 days will be over by then)
Believe me, its not easy going thru these phases.
I do not know how to reach my congressman/senator, Anyone here, pls let me know. I am from fremont, CA.

CIS director is saying that he has made arrangements to pass on the flowers set to CIS office to the US war-wounded soldiers.
I think we should start a blood donation campaign to impress upon him that aspiring immigrants will not be found lacking in caring for the US army soldiers.

It's been about an year the case has been closed. I can't expunge it for 4 more years. The attorney said it may not be under CMT. I think even though we expunge it, in future where ever we go, if asked that ever got arrested, we need to say YES right?
My attorney says it should be OK.. I am not sure what to be done as you said it all depends on the VO
I am praying god for the silly thing have done and help me in this..

When the VO asks, you would be pretty much justifying why you are "not inadmissible"
Just write down the facts that support your case, and have documents ready (like court disposition, may be a written statement from immigration criminal attorney that your conviction doesnot render you inadmissible).
While i don't know whether you did intentionally, but certain silly things like this can change somebody's life forever. I hope other wouldbe immigrants learn lesson without actually having to go through this personally.
While i have no vested interests, but money to immigration attorney is worth for such things.

It's cheap, and long term free advertisement. I would say IV should distribute attractive non-controversial bumper-stickers, instead of flyers which end up in garbage cans

My wife does not ahve paystubs from Oct 06 to Dec 06 and no W2 for year 2006. SO I would need a absence letter. Any for mat of letter would be appreciated.
We have paystubs from jan 07 to Jun 07 and plan to leave in July after filing 485 and plan to re enter in August using unexpired H4 visa.
I know of someone who used unexpired H4 visa inspite of being on H1 before leaving US
Any issues with above scenario?

upgraded to PP on 19th. No news, No LUD so far....Even though, they saif July 2nd is cutoff date. Something went wrong around 6/20. Dont see any approvals after that.
