I have a feeling that they will HAVE To process EAD's in 90 days( that's what the current rule says ) or reinstate the Interim EAD's - terminating Interim EAD seems like the dumbest move they ever made. If either of these doesn't happen, lawsuits are sure to follow. So, don't worry too much about it my friend.

Earlier it was 140K times 7% = 9800 with everybody and now it is 90K times 10% = 9000 with most of them gone into new merit based system.

what do you mean? Who are these rest who will go into a new merit-based system? Even if you count only the number of people here who have approved I-140, that alone is enough to delay us for a very long time even with the current quota (140K). Otherwise we would not have had retrogression.

I am in the same boat and my employer has decided that they will revoke I-140 no matter what. Can you tell me how did you find out that your employer revoked your I-140. Maybe he/they did not. But my firm is really big and they go by the rules. So I just want to know whenever employer sends the revocation, does USCIS always revoke or it is upto their discretion whether or not to revoke. Problem is I do not have a job yet so I cannot even file for AC21.
From what I have researched over the internet, employer can withdraw anytime. USCIS may work on it anytime, maybe in a month or 6 months or probably when they adjujicate/preadjujicate your case. The short answer is most republicans voted yes for the senator Cornyn's bill to recapture the unused employment -based visas from previous years and almost all Democrats voted No (except Murray democrat from Washington voted yes for the bill. I guess Microsoft does have influencial power on the senator from Washington state)

"Retrogression" is the word for the rest of the year for EB3 (I). Learn it, Leave it (eat it, sleep it, drink it - whichever way you want it).
How about Dec. 2000 EB3-I for incoming bulletin? Then "Retrogression at will" as we move forward for the rest of the year. Now don't ask me how because anything is possible with (fill in the blanks).

* We reported yesterday that foreign professionals have been sending flowers to the heads of involved agencies with a message of protest for the ongoing visa bulletin fiasco. Dr. Emilio Gonzalez responded to such flower campaign in the USCIS site. The flower campaign appears to be a gesture from the community of foreign professionals to thaw out the tension created by the fiasco and at the same time calling the agency leaders' swift attention to the problem and sufferings of the foreign professionals and their family members. This camapaign has been initiated and pushed ahead by the immigrationinvoice.com group. Salute to the members of this group for the job well done.

I don't think that the rules are unfair. If both parents are Indian citizens, then the child is eligible for primary citizenship of India. Hence how can he be allowed to take OCI when he infact can get primary citizenship? Also the rules are created with rules for all countries in mind not just USA and also they are intended to protect those who lived in India, paid taxes in India and these rules are to protect interests of children born in India.
I live in US with my wife, we dont have any kids and yes I am in race for GC. But I also know a few couples who applied for US passport for their kids, went back to India, got their kids educated at Indian Citizen's fee schedule in general quota and then sent their kids to US back with citizenship of US.
Unless in some exceptional cases, I don't think US kids can education in India at regular fee schedule. How do you prove your kid is an Indian Citizen, to consider your kind under regular fee schedule?
So..... didnt this put Indian kids born in India at disadvantage?

June 20 is the RD (paper filing). Service center is Texas. EAD expires on Sep 24th.
Case status is still "Pending"!
I applied on June/25/2008 (Efilling) for me and spouse. My receipt date was on June/26/2008 for both EAD and AP. Still waiting for approval.

These ppl are talking about giving amnesty to ILLEGALS...let me repeat it.. amnesty=award for being ILLEGAL. They have done that before and all of a sudden we F'KIN LEGAL TEMP WORKERS from India/China have to worry about the LEGAL aspect of filing a law-suit.
Something is seriously screwed up with this. This is no different than a pseudo-SLAVERY. Now all of a sudden most of you will say, no one put a gun on your head to work. Ofcourse not, but why hell do they create a dual intent H1FU?K Visa where they show you the carrot and create a indentured servant system and discriminate on the basis of the country of your birth. It is discrimination. Trust me when there was SLAVERY in the US , it was defined LEGAL.

I am facing same issue....need to get some money back from India....and there is no way i can get it officially without losing significant part of it. It is really illogical to send money to India for property investment just because we cannot get money back.....I am repenting doing that....
Whenever I ask my friends to do this favor to me.....all they say is they dont have money to send India (since they dont want to disclose their worth to me) or they dont want to send money to India since they know it is useless to send money at such a bad conversion rate.
If you can find some better way, let me know too.

I just want to make sure that IV not forgotten People that stuck in PBEC. So far as an active member and an active contributor for IV I have to say that I'm dissapointed as far as the way IV addressed PBEC Issued.
Most of disscussion in IV forum seems like focusing on retrogression issue only.
for people that have their case are among 350000 case pending in PBEC the retrogression has no effect at all unless their case clear out before the retrogression get solved.
There are so many of us had been waiting for their labor get approved.
5, 6, 7 year are a long wait.
I noted that IV do have PBEC mentioned on the web fax, but please make sure that retrogression is not the main goal of IV.

am not able to be there these days as I am travelling for work during this time. Also, I have 10k United miles with me, and I would be more than happy to donate it to someone who can travel. But I am not sure if 10k is enough for a round trip. If some one has any inputs on this, I am happy to be of some use at atleast by giving away these miles.

India EB-2 moved by approx 6 months. China EB-2 did not move. Actually, EB-2 India has gone back to where it was before it became unavailable last year. Unfortunately, we may not see a lot of further movt in EB-2 India if all those labor numbers (cleared) are correct. But this is good news for those who applied for labor in late 2002, but their application was pending for a horrendous amount of time and just got cleared. They can get EADs.

See we dont know what you wrote, so without that you might find people that find it offensive, simply because they have no idea what you just said.
It is like you going out with friends and one of them doesn not speak your language, so wouldnt you speak English to make sure he or she isnt left out and feels uncomfortable?

It looks like you can show some light on my stuggle with ICICI bank to deposit money in My ICICI NRE account.
Story is like this, I went to India this summer deposited money to several mutual funds from my ICICI NRe account. One of the investment (in franklin ) was wrong by the mistake of my agent ( because US person can not invest in some of the US based mututal funds and frankln is US based fund) So I had to struggle to get money back from Franklin, as it was not proper investment ( wer mentioned NRE US based in forms, so they should have out right rejected investment, but they alloted it and then I have to fght back to get it returned)
Luckly due to my correct application I was able to get money back from franklin. they issued RS check, which I tried to deposit to my NRE account at ICICI bank. ICICI rejected check saying it is in RS. I tried to persue them it is REFUND FROM MUTUAL FUND (NRE INVESTMENT) from the same ICICI account but they still wants the proof that it NRE money. I have still this check bouncing back between me and ICCI bank. I also approached franklin to get letter. This time they have qouted some earlier RBI rule ( I have not read letter) and I am trying to redeposit that with check again.
Here in this My bigger question is we all are investing lot of Money from NRE account in Mutual funds and other investment options available to US in India as NRI. but when it comes to getting money back in our NRE account ( naturally all returns/refunds from India investment will be in RUPEES CHECKS ONLY) then we have big trouble like One I am facing right now.
SO DOES OUR INVESTMENT IS TRUELY REPRETRIABLE.
WE CAN GET OUR ORIGINAL INVESTMENT AS WELL AS GAINS ON THAT BACK TO NRE ACCOUNT OR NOT
IS IT THE ICICI BANK ONLY or ALL OTHER BANKS ARE GIVING TROUBLE wHEN WE TRY TO REDEPOSIT OUR MONEY ( in rupees) back to our NRE account.
Please explain your experiences in this regard.
