    Looks like you are using online degree to support your case as well, that is why you are so pissed off. No matter how loud you shout or how many people you threaten about lawsuits and all that stuff, no one can deny the fact that an online degree does not have much of recognition.

    Say in clear and simple words -- are online degrees from University of North Dakota, University of Massachusetts, North Eastern University etc. legit ? Yes or No

    Your beating around the bush and twisting words just show you have no argument. Didn't your MBA teach you that there is something called logical argument? Or was your degree from the like of TVU ?

    It is only YOU who think that online degree does not have recognition . If you are yet to understand the power of Online educatoin you are probably living in stone age.


    BTW, I do not have a online degree (though I plan to go for an online MBA) but I am pissed off when I see some so called educated people are so eager to get a GC that they will probably kill others to make their way.

    If point sysem is introduced the big losers are immigration lawyers as they cannot make money in multiple stages. So no wonder if they oppose. Of course there is some limitations but its sucess depends on rules and regulations. Also there is going to be a Cap and there is going to be a provision to prevent displacement of US workers as the worldwide demand is always here. But main advantage is it will bring down the work load of various agencies like DOL and INS also employers.

    It will bring down the workload? Can you explain how? If anyone in the world is eligible to apply for the GC without sponsorship, the system will be flooded with applications, irrespective of whether they carry any merit or not. What makes you think that an organization that cannot process 140K applications per year can handle millions?

    The point based system sounds great in theory, but cannot be implemented efficiently by the U.S. as long as it remains the most desired country for immigrants. It works for Canada, Australia and the U.K. because fewer people want to move there.

    Seems as though every time there is a funding drive there are always people who come with questions that have been answered so many times before.     first of all with that Matloff paper u proved a point that i was trying to make and that is the fraud cases are way more than 20%

    Matloff making the "fraud issue is irrelevant" statement is hypocritical , but he's always been that way. it doesnt fit in *his* larger scheme of things which tend to get balanced out between the pro and anti immigrants in the *larger* aspect of things

    but the "brand equity" being tarnished is so tangible and digestible at the grassroot level to makes it a public issue

    yes the larger context of the racist/xenophobic issues will always be there as i earlier said

    I think IV should work on filing a CLASS ACTION LAWSUIT for several reasons. Are we going to be coward legals waiting, for lazy folks at USCIS to undo the wrong they've done for so many years.

    1. Blatant errors in the processing which has, destroyed , causing huge stress, trauma and what not to ppl waiting in limbo.

    2. Inability to provide any insight on the basic timeline for any application. Look at the EB backlogs, they change there bulletin as if its a stock market, it can go forward or backward depending on the mood of the ppl working on any day.

    3. Immigration is a burden on the legal immigrants, we pay for those ppl jobs. How can they offer such a sub-standard service, considering the hefty fees they charge from us.

    4. The US constitution says " We the people", does not say "Legal Aliens" don't have any say or can't ask for justice.

    5. We are legals, did not cross any border like those illegals, which this administration is so concerned about. We pay for services, not screw ups!

    6. Lost EB visas for USCIS / DOS mis-handling.

    7. Even if we loose the lawsuit, still we made our point. USCIS sucks! period

    Ok now, i'm ready for all the red dots, who think that keeping quite will some how magically solve these problems. They need to be held accountable for what they've done.

    In America - anybody can say a racial slur against you and they will not be prosecuted under law - you can also do the same without fear of prosecution. Although both of you might loose your jobs because you work for a private company - they have the right to fire anybody they want. First and foremost - please respect the freedom of speech - words dont kill!
    Here are a few things that might help shut up folks who talk against you...
    1) There is no reason to be overly sentimental about anything (being sentimental and having a sense of entitlement is a desi trait that needs to be gotten rid of as soon as you get off that plane at the airport - it is something that should not have been there in the first place. You are not special, this is not your country, the ppl over here are not dumb, you are here on business and maintain that attitude. If somebody misbehaves with you tell outside of work, them to f*** off - if somebody does that at work - you can reply to them without using abusive language - because abusive language might get you fired. If you HR is effective complain to them - but I prefer to handle it at an individual level - because I am not scared - thats the beauty of America)
    2) Dress properly - get a haircut and dont use cooking oil instead of gel. Get rid of the moustache if you have one. Make sure you dont stink. Dressing up smartly elevates your image - remember this country is very image conscious - which I think it should be. Dressing nicely and smelling good will not hurt anybody. To all desi women - please get rid of all the facial + body hair that is visible. Please wear makeup - because you may not be naturally beautiful. Donot act like slobs - nobody likes that.
    3) Respect boundaries and dont make other ppl smell your food.
    4) Be positive in your attitude, improve your communication skills and dont act servile.
    5) Most desis are hard working and responsible people - nothing should hold them back - not certainly the need for an image makeover.

    All fellow desis take care and enjoy your life here - life is too short to be depressed about the green card everyday. Most important thing is you stay happy everyday - here or in India.

    Nothing significant is expected from this speech. Most politicians repeat the same 3 things- Secure our borders, provide path to citizenship to millions and welcome best and the brightest. The real question is when they will do the real work on immigration. There have been some discussions on administrative fixes on immigration. However some of these fixes would politically harm democrats in the upcoming elections.

    H1b and Green cards are allowed to have out of country stays. so if you are out of country for less than six months, it may still be considered as continuous stay. the intent of writing the word "continuous" is to declare that at any point, the immigrant had no intentions to leave the country and relinquish his immigrant status. for the legal immigrant, that should be acceptable.

    Looks like it is for illegal immigrants as it asks for continous stay. Most legals would not have stayed continously as they might went out of country for vacation

    Hi,

    I am joining with Tek systems and they don't give as permanent position in offer letter rather just said contractor.. but I am full time with my current employer.

    Do you think its going to be any problem from changing Full time to Contractor?

    AC21 letter - wording is very important - the offer MUST be Permanant fulltime and the prospects for future employment must also be good - this is exactly what they request in a RFE or a NOID.

    If your letter says it is temporary position, you will have issues.

    Same with one of my friend - his PD is EB3 2005 India - he never received his FP as yet and is just planning to wait it out. Gets his EAd and Ap renewed regularly.

    I know 2 friends who filed in July 07 and got their FP notice last month. The explaination they got was their applications were struck in name check and once that was over they issued FP notice. This was news to me.

    Guys, this is the time to show the core group that we are a bunch of people thankful that there is IV to help us fight this fight.
    We need to stand united and raise awareness and sign up for the $20minimum a month recurring contribution.

    I understand that some of you do intend to contribute and have contributed generously in the past,
    But here are some mindsets, All of us fall in these 4 mindsets.

    1) you probably think "why should I sign up for a monthly recurring contribution program". I am a generous contributor and I contribute almost monthly anyways.
    2) I have contributed enough.
    3) I will contribute if I feel like, when I see something comming out of this effort.
    4) I do not have to contribute.

    If you are in category 1).I can tell you, I understand because I have been a generous contributer in the past. But guys, the reason I signed up for a monthly recurring contribution is that it helps IV know that 'X' amount of funds are guaranted every month, this way they can plan better.

    Category 2) Contributed enough - Okay why dont just sign up for a minimum amount of $20/month once more. What is enough is not enough.

    Category 3) This has been discussed, I do not want to talk about this category of members.

    Category 4) Again - No Comments-

    Lets show the core team that all of us fall in the first 2 categories.

    The last thing we want the core to do is bite their fingers over funds. We do not want the core to get stressed out over funds. They have enough real work to do already.

    I give all of the ones that have not set up a monthly recurring contribution benefit of doubt. May be you were not aware that this organisation and the lobby money has come out of pockets of ordinary hard working people like you. But this is our last chance. WHAT ARE YOU WAITING FOR?.

    How many of those 245(i) cases from April 2001 might exist in the EB3-India bucket?

    From what I read on some of these forums, there could be 8-10 million 245(i) cases in all, filed on or shortly after April 2001. Were these filed as EB cases???

    IFF this is the case, then EB3-India will likely keep going back and forth between April 2001 and December 2001 for the next several years. Though it doesn't make any sense how EB3-China and EB3-Mexico made it to 2003.

    Call yourself a shoplifter, but you are really a petty criminal. You have yourself proved so by pleading guilty.
    I am surprised that you have not been deported. It people like you who bring a bad name to the whole Indian immigrant community.
    Far as I am concerned, unless you hae situation of life and death, you must not steal. The only other scenario, where theft could be pardoned is if you are out of work, have no money, have no friends who would help you, have been turned out by the local soup kitchen and the food bank, and have starving children at home and you decide to pich a loaf of brad from a store
    Other than that, no excuse.

    For all who replied well to my thread.. Thanks a million. to whom, trying to blame me etc.. If you want to reply with good answer you are welcome to do so...else DON'T EVEN REPLY.
    Now another question to you guys who are blaming me......
    Did not you guys ever used office stuff/taking printouts of ur personal use/ using ofice phone for personal use etc in your life? If you have done so.. YOU ARE ALSO THIEVES. YOU did not get caught, thats the basic difference...
