Research has shown over and over again that "talent, mental capacity, innovation and learning abilities are distributed evenly among different races and ethnic people..."
So there is no dearth of talent in south asia or any part of the world when compared to US or west. It's just that there is a difference in harnessing that talent...
Look at this way...You might like indian classical, but you might not appreciate western opera...That does not mean that western opera is not upto standards, or vice versa...AR Rahman's music is exceptional...no doubt about that...Because of the way movie makers want in India, it is geared towards indian market...It would be suicidal for indian movie makers if they ignore that...
Moreover, until recently, there was no separation between movies and music...Music is pretty much wedded to movies and vice versa...Whereas in the west, music is a separate entity and an industry of it's own...If you have a separate entity like that, it is easier to put your skills in a variety of ways and therefore easier to showcase your talent and easier for others to spot the talent...
Also, in India, movie industry is more paternal of nature...Barring few exceptions, irrespective of talent, some actor/musician, etc. get the roles because his/her family is tied to the industry...(Although it's slowly changing now)...Because of this, you might not get the best talent even though it's out there. Ofcourse, in the west also, you might see the same here and there, but IMO, it's more prevalent in indian cinema...
Lastly, spotting talent greatly depends on the director. In India, we hardly have exceptional directors...Also, I suspect the directors in India are given as much freehand as we hear in the west. Buddy, your tone sounds hostile and as I said we're staying here by choice - but let me tell you this, after getting an MBA (with financial aid) from a decent school here, staying here for a decade, getting into upper management of a large company and having US born kids, I'm relocating to India after the summer. I've just secured admission for my first born from here and it went without a single glitch.
So, YES, I've tried it, I'm pretty darn willing to and I got a strong pair of balls!

I just wanted update this thread with my experience. Could be helpful to people like me who searched many forums frantically. I have 10th year h1b extension valid upto 2010. Instead of going for stamping at US consulate in India, I decided to use advance parole. Most troubling thing about my history was that I had one dwi (Driving While Intoxicated with Alcohol) offense. It is not a deportable offense. However, I was concerned that it would show up at port of entry and they could ask me to go back for consulate processing. I kept all my case related court documents handy. This is very important for anyone travelling with dwi or other serious charges against them.
Officer directed me to the secondary inspection. Another officer there entered my information into the computer and after making gazillion keystrokes, he stamped my advance parole document/I-94 with 1 year validity. I got up from the chair when he called my name, walked upto his counter and took my documents from him. NO QUESTIONS ASKED. NO BIOMETRICS.
Hope this helps others.

I am not sure any one one of the people who made the above posts have their GC......... I would actually agree with mihird.
if you plan your life, you can overcome most obstacles, not having the GC included. it is folks who do not plan long term that are in trouble

I would also check if your original GC sponsoring employer (Company A) is not involved in any fraud investigations by USCIS. In which case, USCIS can revoke an approved I-140 without any notice on the basis of fraud, which would automatically lead to your I-485 denial. I-140 online status may or may not change in such cases. Your case being in extended review is raising some flags. Do you know anything about the kind of extended review that was going on. Your lawyer on file, as well as you should get a copy of the notice. Make sure no communication was sent to the lawyer from Company A. Sometimes USCIS does not update the lawyer information even though a new G-28 is submitted. You will have to just wait for the denial notice. Send an email to info at immigrationvoice dot com so IV can get in touch with you to help.

I dont see any grounds to file MTR based on the fact that beneficiary does not have a US Masters degree which is the requirement as indicated in LC filing. I dont think you can do anything with respect to USCIS's mistake in approving I-140 earlier and now denying it. Got to wait and see what the attorney's view is in this regard.

Are they not supposed to make sure that they have enough senators on their side to pass this bill. Whatever we have won till this point is due to the efforts of core team and people who come to this website using media/campaigns. I have not seen results of any lobbying efforts by this lobbying firm. Am I wrong somewhere ?

I am EB-3 India and I am just 16 years away from my Green Card. My daughter would turn 21 in 2025 and then she would be able to file for our GC under family category. Also, I would celebrate my 25 years on "temporary visa" status in 2025.

I am also proud to live in such wonderful country who are open to any new talent and do not hesitate to honor anyone irrespective of their color,race and religion. I wish all countries take inspiration from it.
I share your enthusiasm, for now. But it is not always like this, and will not be like this. So lets cherish these times. Great talent and greatness has been rewarded with obscurity, more often than not.
Here is an example - Do you know who invented AC current, electric motor, laser, x-ray, radio technology, wireless technology, cellular technology, neon, remote control just to name a few. There is not a minute that goes by in the life of modern humans when we don't use inventions of this great man, but over 99% of all people don't know his name. Everyone will call Einstein a great scientist. But this is the greatest, and how come so less people know about him?
Reason, he was not American, British nor a Jew. So history rewarded the greatest scientist with obscurity. And most of us don't know about him.
The point is, great talent is not always rewarded as it should be. We think that we are talented and that's why we are on "special" visa. The fact is, we have chosen to be part of the system, that makes a rich guy richer. As long as you are in the business of making a rich guy richer, or as long as you are part of the system that makes more money for some hotshot powerful banker, we can all continue to live in this fool's paradise claiming that any new talent is always honored in this GREAT country.
