Project_A - Were you ablle to file Eb2 and got approval after doing online MS ? How does USCIS treat online MS compared to full time MS for approving under eb2 ?
I also have 3 year degree + 1 year PG+ 20 years progressive experience. How can I file under eb2 ? I heard that USCIS looks for 4 year degree for approval under eb2.

You all are right that we should not divide ourselves on EB2 and EB3 basis. But it is true that there is no hope for EB3 unless the point is raised for it in IV drive. EB3 is a hopeless case. People are so frustated since they are unable to decide about their future. Let's do something for it too.

One of my co-workers started me with a gun range membership...you can even find ones that dont require membership...just show ur drivers license and rent guns from the range & dont worry about carry permits...etc etc

I've had both kinds of accounts for years
NRE - you can only deposit funds from abroad, but cannot deposit funds into it from India. Havent repatriated back - so not so sure abt those rules
NRO - you can deposit funds from abroad & any money you receive in India - eg. if u get rent, or your PPF money etc. Bank will also deduct TDS on the interest you earn in this account. Not so with NRE. Legally, when you leave India, if you do not close your accounts, you shd change the status of ur existing a/c to NRO.
As far as the issue being faced by OP - dont know how much money we're talking abt here, but if your folks send u thru legal channels, they will have to explain why the money is being sent.
If you have an NRE or NRO account, the money cannot be deposited into those accounts from India. This is my personal experience.

I am no expert here but know that most of my friends did not have priority date current but were getting EAD/AP all the time. So once filed and accepted (receipt#) I am sure you would get an EAD/AP (the first one would come quickly 2-3 months) then extentions of EAD/AP might have a different outcome.

Thanks anyway for that answer. My situation is different beacuse with the I-140 PP going away for now...and my H1B expiring Feb 2008...I am left with approved I-140,Labor and retrogressed dates to be eligible for 3yr extension.
Now that if 140 is pending ...then I am left with EAD as the only option to continue manitaing my status.
Correct my intrepretation of law if wrong..
If your labor was filed after Feb 07 (since your H1 expiring in feb 08) and your I-140 does not get approved by feb 08, then EAD is the only option to be in status, (unless u join Patni, TCS, wipro, Infy on L1 :-)

Thanks lazcis. I would like to know if a person who has H1 valid until jan 1, 2009, files for AOS on oct 5, 2008 and then goes out of the country in Dec 08 and get paroled into the U.S as "AOS" in his/her I-94, using AP. What happens to this person...is he/she still deportable even though that person is now officially on AOS.

I would sympathize with you if you can do the following:
1) Show me that no more than 90% of the population experience depression tendencies at some point in their life.
among EB applicants I believe it would be 99%. So are you alone? I guess not:D:D
Things you could do: Try watching talks with the Dalai Lama (available on youtube). Read books on Gandhi. Increase frequency of quiteness / meditation. Watch atleast one comedy show per day. Visit/remember the sick/disabled/poor or other less fortunate people than you.
Things you could avoid: Heavy drinking. Watching news, movies/shows which are high tension. Most important is not to fight the emotions/thoughts that you consider are destructive. Allow them to come and go. Just watch them come and go........
What you consider as "Good luck" can happen to you in the fraction of a seccond, however, it will never happen if you keep on defining yourself as unlucky. So focus on the good things you have now and refrain from comparing to "what you should be having or are worthy of having". :D:D:D:D

I-140 premium processing was stopped last year...It takes upto a year or more to get I-140 approved, that too if its a direct case...If its a interfiling case to capture PD from Eb-3 to Eb-2, then its taking even longer..One of my friends filed I-140 in March 2007 to capture his Eb-3 PD of Apr 2004 to EB-2 and he is still waiting....I-140 processing dates are well beyond his receipt date but still his application is pending....So porting PDs is not that straightforward these days...

My apologies for nitpicking on the DONOR definition and Congratulations on the new management philosophy you are going with. I hope you succeed in your endeavour.
Still I've some open issues. If you look at the poll, there isnt a single person who voted NO. We should expect to see a healthy mix of Yes,No and Dont Care. But the way the poll has been put and partly the wording, partly the current IV environment, people are sceptical of putting their real thoughts publicly. This excercise is futile if you have minimal 'NO's --- hope you are getting my point here. The only thing you might end up with is x number of YES and hope to translate the YES into more dollar value for IV and there will be some YES who are already contributing monetarily.
You are right in saying that we need to increase dollar contributions but tying it to frequent updates is not a practical thing. There are reasons IV Core cannot share their strategical plans with the masses and this is true in most places. By saying donate more and get more updates, we are setting us up for failures esp. if we expect 'real' updates. Even in an ideal situation, you will not have real changes every week and certainly not regularly.
And once again thanks for the healthy discussion.
