Showed his frustration and disappointment very well. Overall a well done and convincing piece.

Taking a plunge now on EAD is like drowning yourself. prices have not yet come down and will come down by 15-20 % over 5 years. there is talk about recession , job losses and more foreclosures. if you dont need the space ...DONT BUY. most of us dont need more space unless we have 2-3 grown kids who need their own rooms. renting is not same as throwing away money as you get a place to live. how does buying a home give you security ..it is more of a hassle if you are on EAD or H-1 and you need mobility after a job is lost. my friend who has good worldly experience rightly said ..buying a house now is like worrying about one more thing in life.
If buying a house had been the smart option, I would have bought it already.
Please see the attached XLS.
BTW, independent analysts predict that housing prices will fall by 20% in real terms in next 10 years.
All I am stating is that this issue can be a good talking point for the Immigration Lobby, especially as the housing market continues its slide down:)

I never said 80,000 FB visas are reserved for EB. Then those numbers would not be called as FB visas, would they?
Any way, if you look at the statistics (page 52, http://www.dhs.gov/xlibrary/assets/CISOMB_Annual_Report_2007.pdf), USCIS has not fully utilized all available EB visas for 12 years out of the 15 years. Hence I said, USCIS is THE bottleneck. For the 3 years (out of the total of 15 years), unavailability of visa numbers is THE issue. But for the majority of the years, lack of visa numbers is NOT the issue.
When is this name check reform getting implemented. Why is is so difficult to implement ?

They change this number later in the year, since some of the FB visa allocated are retruned back to the pool (if the person getting GC does not enter the country in specified time).
They allocated a huge chunk of EB2 Visa to South Korea 7125 (currnet all through the year). Same with EB3 SK got 4727 (close to sum of India and China).
So i agree things will move slower this year but still move forward. We will not see an EB2/3 India/China Current any time soon unless they screw-up again like july 07.
sachung22,
Approximately what cut off dates your expect for EB2/3 by Aug'09?

Congrats on getting your green card. its nice to see people like you visiting and participating in IV after getting green card.
I have a question for you. You said in your post below that your 485 was approved end of september 2008. But I thought the visa numbers were already exhausted by august 21 2008 for eb2 india. Are u sure you got approved in end of September 2008 and not in august, did you actually get an email end of september or your LUD on 485 was actually end of september. Please dont get me wrong, I am not questioning your sincerity, I am just trying to understand if infact some case were approved in september as well for eb2 india.
Its a small good news. I got similar status update last year sometime in Aug/Sept before my I-485 was finally approved around end of Sept '08. My case was originally filed at CSC and then was transferred to NSC. I got this message when NSC finally picked up my transferred case, dusted it off an (I'm guessing) input it in their system. Most likely your cases went the similar route and now they have been finally picked up by the destination center for processing.

Collecting contributions and spending them on political influence activities without making sure that all legal requirements are fulfilled is a dangerous endeavour. I hope you have everything set up the right way so you don't run afoul of the law (fixing retrogression is not going to do you any good if you are fighting a federal wire-fraud indictment at the time of your adjustment interview).
Very interesting thought....I like your choice of words....wire-fraud indictment....looks like the way your portray the officers, they all seem to be in this for money...right?
Lets take a step back and look at the income of the org till now. As we have displayed on the website, we have collected USD30,000.
Consider that there are 5 board of directors of this org. These guys are all well settled in their jobs and earn a decent living.....but hey here is $6K for each of them now :). Of course they will do a 'wire fraud' for this USD 6k after all this 6K will buy them a new house and a mercedes...right? Who cares about felony, 6K can change anyones life....wouldn't you hadron be willing to spend a year in prison for 6k? Sounds tempting right? Oh wait, but the amount is not really 6K since we have hired QGA. Dang, there goes the dream of owning a beach house with a mercedes!
To think of something like this is not just ludicrous, its downright insulting....instead of encouraging folks who have taken upon themselves to do something about it, you are hell bent on spreading malice and sowing seeds of doubt in everyone's mind! We very well know what we are doing and we are doing so in a 100% legal manner.
Forget about us, do you think a firm as reputed as QGA would want to associate themselves with an org like us if we were not legit? Think again! Some of the folks who had gone to DC (on personal expenses, mind you)to have a preliminary discussion with QGA actually met Mr. Jack Quinn who used to be a legal counsel to Bill Clinton...do you think he has time to meet crooks who don't know a word about law and are doing something illegal? I keep on repeating myself, but if you go to the website, you will see Mr. Rajeev Khanna's email endorsing us. We actually met him in DC too. He has put a link to our website. Same with Attorney Matthew Oh. And how about Dr. Richard Florida? What are the odds of him endorsing an organization which is 100% illegal and committing a wire fraud? The answer is very obvious
Also, if you want to collect significant contributions, you have to instill some trust into the donors that their money will be used for the intended cause and can't be siphoned off by a member of the organization.
Ahhh...you make us dream of our beach houses and mercs....USD 6K....I could retire on that ! Please choose your words carefully. You should not be using words like 'siphon' so casually. We are proud of what we are doing and do take umbrage at ridiculous claims
So, before anyone decides to attack me personally, please come back with answers to these questions (or better, put them on the website for any potential contributor to see).
There will always be naysayers for everything! But I would like to clarify if IV can legally get representation from QGA, provided we do get the money collected? That will be the critical difference between our previous efforts and IV!!!
I think I have answered all your questions as well as I could.....if you are still not satisfied...send me your phone number by private message and I'll call you.

I am currently on H1B visa and I want to switch the company. New company is not willing to do H1B transfer and want me to work on EAD. I have pending I485 EB3 ROW with priority date of March 2006. Its been more than 180 days that I filed for I485 so I can use AC21 with EAD.
But my question is how risky will it be if I switch job at this stage with EAD?
Thanks in advance,

I think this law puts an enormous burden on us to prove we are here legally. If for any reason we are stopped for speeding, the law allows the cop to ask us to prove we are here legally. technically, he is supposed to verify this with USCIS, but we know how efficient they are! Also the average cop probably has no idea what EAD/ Adjustment of status etc etc are and this can land us into trouble, atleast until we prove that we are here legally!.
Not only is legislative reform for legal immigrants held hostage by illegals and their lobbies, but actions directed against them are likely to entrap some of us into trouble with the law.
I hate illegals!!!!!!!!! And their !@#$ patrons in washington!

You have some very valid points about community (non)participation in your post.
I understand your point about having another rally. Make no mistake - IV core has no problems with planning and conducting another rally. So it's not a big issue to get them to agree. I can push IV core, and get another rally. Bigger issue is how many are going to turn up? If it's just 100-200 of us same-old folks, there is no point.
Last year when we were bouyed by the success of July VB reversal, it was estimated that at least 10,000 would turn up. But, only 2000 did. I don't know how many will, if we hold another few months from now?
IV can sponsor more ACTION (items). But what's point, if there is not enough participation? First step is the community needs to step up and make existing action items such as FOIA requests for backlog numbers, AC21 action items successful. This will motivate IV to launch more action items. No organization would want to be seen running too many campaigns with liitle or no community participation.
We need the IV core team and the administrator to guide some big rally's. Guys nothing will happen until we are bold about our intentions.
I noticed everyone comes up with their different ideas, but no one works to implement it. We need to stand together and do something big, when was the last time we had a big rally?
And how many people actually showed up? Desi's wants everything fast and free, the problem is lately IV thinks too much and has less of ACTION

Hello Everybody
This is my first post. I worked my ass off to get a favorable
solution for retrogression during the budget bill. But as everyone knows it was defeated in the house reconcilation. I'm not being pessimistic but my gut feeling is that eventhough senate comes with something, the chances are slim that the house would agree to it. Sensenbrenners bill which house passed has no provisions for EB immigrants and backlogs. I'm pretty sure all of you are aware of Mr. Tancredo's fury against immigrants too.
Having said that I dont mean we have no way out. We have to work very very hard. We have to raise money and do some hard lobbying. But above all we have to get our employers to back this issue. With all of the above reasons I think it might be a very bad idea to guess we would have any favorable legislation in a shorter span of time. So we have to plan something for a longer period of time and execute it very diligantly, I guess.
I think Immigrationvoice is on the right path... Lets face it people!!!
thanks
babu.
EB immigrants are not a hot political issue with the House, when the illegals are. Nowhere do the house representatives, except Tancredo and the likes, voiced their opposition to expanding EB immigration and providing some sort of relief for people caught in the backlog. I believe that the immigration provisions were dropped from S.1932 just because it was a wrong bill. The pork got chopped off and this pork was too easy to compromise as there were much more important issues to fight for, like drilling in Alaska and Medicare. This bill IS about immigration issues and is about border security issues as well. The fact that Frist's bill drops the very controversial guest worker program can be considered as both a good and a bad thing. It is good since the bill will sail more smoothly through the Senate and hopefully the conference. On the other hand it is bad since Senate representatives in the conference now will not have this guest worker program to trade and drop when House reps will demand to drop something off the bill. To my understanding the way the conferences work, they need to meet somewhere in the middle in between the versions of the bill and since we have the very minimalistic bill passed by the House it is the Senate which will need to compromise and drop provisions from its bill.
But taking the guest worker program off the bill is a good start I guess.

this guy doggystyle piss me off, i had other things to do and was not going to attend, but he made sure that i attend and expose incompetency of these impotent people. bottom line - donna wants to be the one to testify to the congress, she wants to be famous. others are idiots and can't see this. here is what happened - total waste of time. doddy is right, could not hear more than 5 distinct voices, they use different ids to make it appear that the whole world is anti immigrant, they even said that on the call, bunch of losers
--------------------------------------------------------------------------------------------------
donna – put in talking points for each article.
kevin – don’t want to look artificial
donna – yes, no copying pasting,
don’t want to put ourself apart from other american in it . the good thing is republicans are on the message and this is what democrats don’t know how to do. democrats are very articulate, but do not stay on the message
core point of the talking points, want to attack h1b only, that’s the core – we are fighting to apply in jobs in our own country
remember, the business week will post link to these h1b only wanted ads
you will not see an american who’ll be happy to see these ads
goto Bright Future Jobs (http://www.brghtfuurejob.com)
durbin bill will not do enough, will only prevent these h1s to come here. but after durbin bill pass, anyone can send this job. in order to apply for a job in nj one has to through pune, india. they ask new h1b to sign bond contract, and if they leave before 18 months, they will ask to pay the fee. this is bond contract which is illegal in america since long time.
kevin – ha ha ha indentured servants
donna – exactly, ha ha, and durbin will prevent this bond contract, if u click on h1b wanted ads
#7 ads says no degree required
#8 ads this is a govt. contract and the company is minority owned - the reason we attack minority owned or woman owned company is, it’s difficult to get this status and they are violating the spirit in which they got the minority status. there is a large number of unemployed h1b, the corporation made a solemn commitment to the us americans, government and to the foreign nationals – the corporations made the commitment to pay the individual and if they let them go or fire, they fly them home. what is going on is aila is recommending to companies that they essentially intimidate h1b when they let them go, making them sign a letter that they refuse to take ticket to fly back home. this is very very important for us to know and attack
one thing that most people don’t know - the indentured comes from the bond contract – the guest workers, h1b, will be never be deported, because, under the law, theoretically, they r never suppose to become illegal. the only people who r deportable r illegals.
some lady voice – this is not a civil and not a criminal offense
donna – no, because it’s the fault of the cos, bcoz the company did not fly them home. and this is one issue that doesn’t get represented in the media. h1b – that doesn’t have job, most important thing to post is – attack that u don’t have job and can’t apply for job
the exploitation which bw is writing about can only occur when these companies can bypass us – the solution to this lies – when companies are forced to hire her
another stupid woman – yes, the it was invented here
kevin – yes, for green card, lawyers find ways around the process
donna – corporation is finding work around to hire american worker,
door bell rings… that stupid woman answering door and cause disturbance for 5 minutes, opening door, dog barking, bragging to the mail man about being on a big “conference call”….
donna - the unifying thing is – corporations are ignoring us to find legal ways to ignore us.
stupid woman - how to answer them on the forums
kevin – just basically reply, and reply, and we have overwhelming numbers on our side
when u see their comments, they have high volume for 1 or 2 days, and then they r gone. we continue to post comments sometimes use different ids and make it look like we are many of us.
donna – we r not going to win the posting game, we don’t want to win the posting game
we are positing similar information, and this alerts the journalist and we have to filter our messages, say we have 20 votes about the bypass of the talent, 20 points about the employment discrimination, we will alert discrimination whom we will refer to these articles,
nyt – article got 1000 posts, and passed to other online journals,
as soon as i started, 1 generalist quoted me and then got quoted more
so the journalist who wrote the article, and those who comes afterwards, they read the post, that is important. we want generalist to read our comments, that we cannot apply for the job, and there is employment discrimination
kevin – you can also send reporters direct emails, i emailed moira of bw - direct emails, and that’s how we got bw article
donna – remember we have a track. after labor day, this is going to be up for discussion, btw, don’t even replicate u’r opponents phrases or never repeat u’r opposition is saying about yourself, so don’t say that there is no qualified americans, say we have over abundance of skill talent, in other words over supply, never say shortage, because u’ll otherwise saying opposition’s message about you. doesn’t anybody… do we want to have a discussion on that.
kevin – we do not have to be dignified in our response
donna - there is not a human on this planet who will believe that there are “want” ads that say –americans need not apply – that will create outrage.
buddy – can i ask a question, i click on an add, it goes to indeed, so this is pulled from rss feed
buddy – so i have many friends on facebook, i can tell them about these ads.
donna – exactly, so the jobs r there but we cannot apply for those jobs. we have doj is making a ground breaking case between ‘employment right and it
silly woman – i’ve been it manager, and know many american who
btw – u’r emotional truth will move people. these people have over qualified beyond the job we are positing, and they do not get hired, and that’s the pattern. years ago, we barely know the material, and we learned on the job, and now it’s the other way around, we know it and we are over qualified
another stupid guy - they fake resumes, and they say on the resumes that they know about oracle rake and unix admin, but they don’t know anything
donna - we are laying the groundwork about the washington beltway mentality, if have to make it look like that employer deliberately pst ads
everyone here on the call has historical record, honest to god. i have a good news, we r standing up for ourself, to tell this story of bypassing the american talent, and that’s what brighfuture jobs is about. that’s what durbin bill will do for us. there are couple of people who will focus on foreign citizens. two things (1.) they will hear from us, and (2.) whether we need guest workers at all, will be taken by afl-cio will pick up. but what we will do, we have absolute unique role to play, we will explain how the culture the bypass impacts us, and the culture of exploitation impacts us. we r the only once in the country who can tell this. there is going to be a discussion in beltway about “whether”, but american worker and american it professionals
no one said that - no foreign worker can come here – that’s not the message – it’s the bypass and exploitation.
donna - no there will be a discussion about no foreign work can come
don’t ever say – h1b is when a qualified american worker can not be found. we have to say that h1b law is about the bypass the american worker – the “discussion” will be about commission – anybody heard about that. the unions are setting commission whether or not we need guest workers – theoretically, and we will come up with the stories, boots on the gound, to show them the data the fuel, makes sense? they can have their tea and whatever stuff, and we will bring the bonfire.
kevin – that nyt story about that google supposedly employee, we have to post messages there,
we have to say that – there will not be an american and naturalized citizen, who say -that its ok to exploitation. there is deep deep discussion about who is an american. alf_cio has broken the opposition, but they r talking theoretically, and we r giving boots on the ground –
employers r not giving us the opportunity to compete – it’s the responsibility of federal govt that we are able to compete.
buddy – most of these jobs are it. someone in background in it can pick up even if there is new technology, but we r shut out by people with lower skills
donna -you r wrong, u r not shut down by people with lower skills, but by corporations
buddy – say 4 h1b workers replacing 1 american workers, they network, and team up to help each other
donna - no, u can argue the cheap, that’s ok, but u cannot argue about losing the right to compete. americans love cheap labor, but we have to focus on americans not being able to compete, its not about low wages.
mike – if u’r real american u cannot work for the 3rd world rates
donna – if u’r real american, u’ll make that corporation compete for these jobs locally. if u want americans, u want to create competition amongst americans here.
when a blackman would work for 10 cents, and white man work for $10, they would choose whiteman, they choose whiteman – because they were
so if u want to argue about wages, that’s cool, u r telling people u’r competing for the job. but the focus has to be on the right to compete.
this guy rajiv was replaced by h1b when he was on h1b. ha ha ha (everyone laughs)
find an american who don’t think its ok to find the people to right to compete. we have not said this to the lawmakers. the moment we tell this to the lawmakers, they will be 100% on our side

I don't understand about this fees.. I mean, you guys would have spent that money anyway. You may be loosing money for medical examination because it may expire. But the rest is something you would have done anyway.. I don't understand the logic of this thread..
Had we know that this was going to happen, at least for July 4 week, we would have planned a vacation and then used that money that we spent.

Not related to this thread but I did not want to open a new thread for this question..
As you can see I am EB2-I (info above) and am waiting in line for my turn but I am just wondering if L1 route to GC is quicker? If so then how?
Not that I am trying to do it because I can not :) but I know someone who just got his GC via L1 in matter of months and here we all EB guys are waiting..
Thanks.
I know people (Indian) who have applied for EB1 after being in L1 for a couple of years and got the GC in 6 months. There is a category for International Manager (or something similar) that qualifies them for EB1.
