I have this doubt also.
If the priority dates are current in Visa Bullettin, the applications will be processed based on RD. If the dates are not current or unavailable, the applications will be processed based on PD. This is my understanding of the process.

Thanks Belmont for support, as explained in other thread for some guy who is beating me or people like us, it's a mistake/accident. It can happen with ones mistake or without mistake (Car accident).. Some one get caught and some one don't... as example I knew many people who steal/use office supplies in the company they work...

NK2006 thanks for the post my family and I recently entered US using AP and fortunately we were not questioned at POE. I am in similar situation waiting for 485 and filed AC21 when I changed jobs after six months.
That is not to say that we will not have problem in future. You mention your wife showed them a copy of rules pertaining to AC21. Can you post a link or post them here.
My lawyer never advised me to carry any such documents.

Congresswoman Zoe Lofgren (D-CA) has introduced H.R.5882 to improve the reliability of the system in which employment-based and family-based visas are issued to foreign nationals. As you may know, many of these category-based immigrant visas have not been issued over the past few years due to backlogs and processing delays at U.S. Citizenship and Immigration Services. H.R. 5882 would help prevent such losses by making available an estimated 218,000 employment-based and family-based green cards that have been unused in past years.
In addition, Congresswoman Lofgren has introduced H.R. 5921, the "High Skilled Per Country Level Elimination Act," to remove the per country limit on employment-based immigrants. You may be aware that U.S. immigration laws limit every country to 7 percent of the worldwide level of U.S. immigrant admissions. This per-country level is established by the U.S. State Department to act as a "barrier against monopolization" and to provide fair opportunities for all skilled and professional workers from around the world. H.R. 5921 would remove per-country limits and would no longer allow unused family- or employment-based visas to be used interchangeably.
Please know that both H.R. 5882 and H.R. 5921 are under review by the House Committee on the Judiciary. However, no companion bills have been introduced in the United States Senate. I think it is important to recognize that our immigration policies must make national security a central priority while at the same time helping to facilitate family reunification and labor demands here in the United States. I will continue to pressure Department of Homeland Security Secretary Michael Chertoff to ensure that any policy to expedite visas does not compromise our standards for accepting individuals into the United States, nor the integrity of our immigration system. You dont need an EAD, if you still have valid H1. AC21 has nothing to do with EAD. However, if your H1 is expiring soon, and you have already used up 6 years of H1, you would need an EAD, because H1 extension beyond 6 years is available only for people who cant file I485 because of retrogression.

I'm hoping to get a receipt notice soon so that i can file for EAD without the increased fees. Anybody has any link to where it says we don't need EAD for AC21 so i can check with my lawyer?

This will be a class action lawsuit which means that all the people who are in the same class as the plaintiff will get the benefit of the favourable decision. Now on whether to file or not, it is an individual decision but most of us have already prepared for the filling so there is no harm in going ahead with the filling. The worst will be to file again but nothing more than that can happen and as I have heard most of the attorney will not be charging again when people will be refiling their cases. So better to file your case and let USCIS reject rather than feel sorry later on if the judge rules in favour of the lawsuit.

I am not sure, but I have heard that most cases go through just fine because AC21 protects you, but only when ex employer withdraws the support for 140, some officers may want to ascertain that the new job is satisfying AC21 criteria and may ask foer more information than that was provided - now all this is based on what people talk about in the forums and on my discussions with people, as such, if you are doing everything by law there should not be any issue

Same scenario in our case. I got my EAD very soon but my wife didn't. We called USCIS and got the stupid response "Wait for 60 days". That 60 days was after we had already waited for 90 days.
We took the infopass appointment and found out that post-mail containing my wife' EAD was returned by post office (USPS). They said they would send again in 10 days.
The reason I found that in our apartment mail box, only my name was written. So after the infopass appointment I wrote my wife's name too. We got it within 10 days.
I think that happened because the USCIS envelop has wordings : "return services requested..."
And I think the main reason is my and my wife last name are different.

Malibuguy007 , you seem to me a guy who could save 2-3000 dollars per month and think you are in heaven(Typical GULTI mentality) . These are the points on basis of which i called life of H1 hell
1. Your spouse can't work . Think about their self esteem and self respect they are loosing.
2. You don't know about your future if tomorrow you loose your job , you will be kicked from this country.
Tell me what is hell then ? Don't think its just about counting dollars , think about your life stability and about your family members too. Try to come out of Sambhar-Rice world(thats the way you save money here and call US heaven). Live with pride ,ok . Fight for being treated like H1 ( HIGHLY SKILLED PROFESSIONAL) not slaves.
