    As of May 2007, USCIS reported a staggering 329,160 FBI name check cases pending, with approximately 64 percent (211,341) of those cases pending more than 90 days and approximately 32 percent (106,738) pending more than one year.

    While the percentages of long-pending cases compared to last year are similar, the absolute numbers have increased. There are now 93,358 more cases pending the name check than last year. Perhaps most disturbing, there are 31,144 FBI name check cases pending more than 33 months as compared to 21,570 last year – over a 44 percent increase in the number of cases pending more than 33 months. (page 37)
    The backlog appears likely to get worse, because a USCIS fee increase -- slated to take effect in July -- has prompted a 50 percent rise in new naturalization applications so far this year.     Currently, USCIS has limited capability to produce reports detailing the status of long-pending FBI name check cases. In addition, USCIS systems do not automatically indicate when a delayed name check is complete and the case can be adjudicated. Often, this leads to a situation where the validity of other checks expire before USCIS reviews the case. Those other checks then need to be reinitiated, adding financial and time costs for applicants and USCIS. The Ombudsman fully supports the expeditious rollout of the BCS system. (page 43)

    PD - July-2004. Pre-Adjudicated.

    How did you know that your case was assigned to an officer. I called uscis three times and I was told that they could not say if my case was assigned to an officer or not.
    some time back when I had called I was told it was assigned to
    an officer (PD not current though). What does that mean?

    my pd is march 07. my agency told me they converted my I 140 into premium on june 18.But my case status still hasn changed from 'RECIEVED N PENDING". Is there any delay by the uscis usually in changing the status?
    Can somebody please clarify?

    My RFE response to the I-140 PP was sent on June 7th but I have received anything from USCIS. Status on theor wesite is still old. Its almost 3 weeks after I sent the response to the RFE. I am not sure what is going on w/ USCIS these days. They have taken money to process it in premium but it seems they don't bother to complete case in 15 working days anymore.

    By March 2007, and using that same calculation, USCIS had a backlog of 1,275,795. (page 11)

    In last year’s annual report (at pp. 6-11), the Ombudsman analyzed USCIS’ redefinition of its backlog. That analysis is not repeated here, as the backlog redefinition is unchanged. The current definition continues to consider “backlogged” only the cases pending after subtracting those cases not yet ripe for adjudication, “where even if the application or petition were approved today, a benefit could not be conferred for months or years to come.
    [Unripe cases are] excluded from the number of cases in the backlog but remain in the pending.”

    Pending Cases Not Included in "Backlog" is 1,316,740 (Fig 1, 2nd column, page 14)
    Total Pending = Backlogged + Unripe = 1,275,795 (page 11) + 1,316,740 (Figure 1, page 14) = 2,592,535 (as of March 2007)


    So as per USCIS a total of 600,000 applications were pending until June. We can add another 600,000 for july-aug... total now 1.2 Million

    Firstly, it is not possible that pending = backlogged + unripe = 600K because there were 2.5M+ pending cases (as explained above) in March 2007. Thus, 600K should be pending EB cases or total backlogged cases.

    Secondly, it is unlikely (although possible) that there are 600K pending EB cases because this means that there are 2M family cases.

    Thirdly, it is not possible to have 600K total backlogged (= EB + Family + ...) as explained in previous post. Thus, assume 400K (out of 1.3M+) unripe EB cases also. So EB total becomes 1.6M.

    Fourthly, consider cases stuck in labor after Aug 17 2007.

    Stoppers idea is brilliant and should be done on a big scale. It will convey a strong message and will be in news.

    Yeah.. what next? shower caps? then groceries? C'mon man. Overdose of anything can be detrimental.

    Just conveying a message is not sufficent. It should be the RIGHT message in a proper way. Flowers was good, because it was the first time something like that happened and it was unique.

    Thanks for your reply.

    I really dont care what my company policy says because as I look at it, it should be my decision whether to work on EAD or continue on H1-B. If they switch my work authorization without my knowledge, then it will be a classic case for lawsuit. Moreoever the policy is not documented anywhere.

    As long as you dont use your EAD, you can continue working on H1B.

    In fact, if it is the same employer as your GC sponsor, you dont have to do anything.

    The thing to remember is to extend your H1B if you do a H1B transfer so you dont have any issues at the time of transfer.

    All this is assuming that your company policy can handle exceptions to the policy :)

    Of the hundreds of thousands of July 07 filers, who paid a mere $325 for their I-485 application, do you think USCIS will devote the time/effort to constantly keep track of the applicant's eligibility of 485 over the next several years???? It will take atleast 4-5 years for several of us to finally get a visa number. Several of us will move/have address changes during these years.

    It took them 2.5 years to process these...imagine the nightmare if they were to try doing subsequent rounds....

    Keep in mind that 485 eligibility is not just tied to employment but also FBI name checks etc. Do you think USCIS will keep on doing name-checks every other year, or issue EVL's every other year if/when they see for instance, an address change?

    Dude...USCIS is already on its way of bragging to the congress that it has pre-adjudicated all these 485 applications. I think if they touch these pre-adjudicated applications, then someone has to answer to someone of what is going on...why haven't you still worked on this? why are you devoting your time to these old 485 applications when there are new ones yet to be processed.

    I think once the application is pre-adjudicated...that's it!! I don't believe USCIS will spend anymore time and resources to these applications again...until a visa number is available from DOS and they apply the number to the pre-adjudicated application....my 2 cents!
    They don't have to do it for everybody. They can always pick a random sample to see how the process is working and do a check on them. As Chanduv23 mentioned if this is not public, they can change the process any time or add more restrictions to it.

    USCIS does not process cases in PD order, because they can't. Thousands of files they receive, are sequenced in order they receive them at Centers. They claim that cases are processed in order they receive them. For them "Receive Date" is not what you see on your receipt, it is the date they physically received the case (thus if case is moved from one center to another, meaningful Receive Date is the date it was recieved by the last center). You see this data online status as "...we received (or transferred) your case on ...".

    PD critieria is limited to certain countries only. Therefore, by and large, "cases are processed in order they are received..." works well. However, for India, China etc. where PD cutoff has to be factored, it is used merely to decide to work or skip a file (when seen in the receive date order). If PD cutoff date is very restricted, they will have to skip a lot of cases, which slows them down. That's the reason every July they ask for wider PD cutoff dates so that they can consume a lot of visas, as they don't have to skip that many cases.

    This process is a mockery of the PD cutoff dates, but that's how it works. If you sent your case on June 28, 07, with July 2, 07 as the printed Receive Data on your receipt, but the case where it finally rested, was entered in their database on Oct. 28, '07 (with a Notice Date soon thereafter), you case will not be looked at, no matter what the PD cutoff date is, unless all cases received before Oct. 28, '07 have been reviewed.


    Disagree, the reason you see lot of cases with (older PDs but later RDs) still awaiting approval is because when the PDs were current these cases were still not ripe (e.g: they were waiting name check clearance).
    Some of them became ripe after the visa numbers were assigned to cases with later PDs and the visa numbers got over.
    There are multiple queues in the system with a backlog at each queue, so some out of order processing cannot be ruled out.

    If a PD of EB2-I 2003 is still pending, its because it was stuck in some other queue before it could even be assigned a visa number and by the time it cleared that queue, the visa numbers were all gone.

    Bottomline, if your PD is not current, you won't be assigned a visa number, no matter what and if it is current it doesn't mean you'll immediately be assigned a visa number, unless of course your case has cleared everything else. With the reduction in FBI name check processing time and the BECs, one can hope the process is much more streamlined.

    The main problem with USCIS is lack of proper prediction. If there are very few ripe cases currently in the pipeline, they immediately open the window too wide, not understanding is that there is deluge of cases with older PDs that will *soon* become ripe. That is where everything goes wrong - their prediction is either too conservative or too liberal.
    However, I disagree that PDs cutoffs are not honored.

    I have purchased 4 firearms during my nonimmigrant status, including a handgun. Nonimmigrants can generally not own firearms in the US. Though, there is an exception to the law if you possess a valid hunting license and have resided in the US for more than 90 days. I took a hunting class, which was a prerequisite for the hunting license and also had very good firearm safety information.

    For long-guns, you will need some paperwork before you go to the gunshop (utility bills from at least last 90 days, hunting license, Driver's license, your I-94 number). The background check will probably be delayed a day or two while FBI checks your immigration status. Your gun seller will call you when they get the ok.

    For handguns, there may be additional paperwork. I had to apply for handgun permits with the local sheriff's office. The person you first deal with will probably be unaware of the exception for individuals with hunting licenses. You will probably need to take a copy of the law (ICE has a pamphlet on firearm laws for nonimmigrants, take a copy with you) and talk to a supervisor. Once you get the permit you take the permit and your DL to the gun seller plus all the paperwork I listed for long gun purchase. Let me know if you have additional questions. Good luck.


    I have been thinking for a long time to own a gun but due to my H-1B status could'nt own one. My I-140 was approved last year and now I am working on EAD.

    I am wondering if anybody else in a similar situation purchased a gun; I mean after he/she started working using EAD. I tried to research the issue but the law is not clear on the subject.

    I just renewed mine today (FL). It was the regular drill: passport, i-94, social security card (optional) and that's it. My new DL will be in the mail in 30 days. In the meanwhile, they gave me a paper one.

    Infopass appt for Interim EAD was not helpful at all.
    They suggested the same that I did earlier, ie to fax USCIS hotline about my situation along with letter from emp saying that I am at risk of losing job.
    I have done that several times, still no luck.
    My EAD expires on aug 30th (yah, just 2 more business days).
    Did everything in my hands, now just prepared to lose my job.

    Surprising thing is I saw 2 soft LUDs on aug 25th and and 26th but still no approval nor RFE, case status still pending.
    I know they are looking at my case, but doing nothing.
    My wife's EAD was approved a month ago.

    I asked my lawyer (from a big firm) if I will have a case on USCIS in case if I lose my job. She said, USCIS is famous for this kind of processing for 1000's still the cases wont stand against them.

    I wld appreciate any suggestions/thoughts?


    Efiled @ NSC on may 19th.
    FP on july 3rd, still no approval.
    My current EAD expires Aug 30th.

    1) Requested expedited processing via phone.
    Received email saying to wait for next 30 days.

    2) Called NSC, agent gave a fax number and asked me to provide Emp letter.
    Faxed the Emp letter and also a covering letter.

    3) 2 weeks passed, still no reply, called up NSC again, explained situation that I wld lose my job if i dont get EAD extension by this month end. She opened a Expedited request and told me to wait for 10 days.

    4) As a back up, I also took infopass appoint for next monday (90 days will be over by then)

    Believe me, its not easy going thru these phases.
    I do not know how to reach my congressman/senator, Anyone here, pls let me know. I am from fremont, CA.

    So far EAD renewal has been taking ?? months. With the additional applications it will take ?? months and we will have to apply for renewal after ?? months.
