I filed for EAD extention from NSC on June 12th. My EAD expires on sept 12th. I also faxed to expedite the filiing, but to no-avail.
On the side note, I met Immigration officer via infoPass appointment and it did not helped either. He suggested to send a snail-mail to see if that helps.
As of writing this post, my status is still pending.

2. Make the check or money order payable to U.S.
Department of Homeland Security, unless:
Good observation. Thanks. I hope they honor, what they have written http://www.uscis.gov/portal/site/uscis/menuitem.eb1d4c2a3e5b9ac89243c6a7543f6d1a/?vgnextoid=db029c7755cb9010VgnVCM10000045f3d6a1RCR D&vgnextchannel=db029c7755cb9010VgnVCM10000045f3d6a1 RCRD also.
On the same page 8 of http://www.uscis.gov/files/form/I-765instr.pdf USCIS has written over-rider:
The form fee on this form is current as of the edition date appearing in the lower right corner of this page. However, because USCIS fees change periodically, you can verify if the fees are correct by following one of the steps below:
1. Visit our website at www.uscis.gov, select "Immigration Forms," and check the appropriate fee;
2. Review the Fee Schedule included in your form package, if you called us to request the form; or
3. Telephone our National Customer Service Center at 1-800-375-5283 and ask for the fee information.
Based on over-rider information,
Fees should be made payable to Department of Homeland Security or U.S. Citizenship and Immigration Services. The instruction to pay U.S. Department of Homeland Security might be old (05/27/08 - just guess based on over rider information).
So I think, USCIS must be accepting payments in various forms of payable to. I can update in one or two days about "payable to USCIS" - Whether accepted or rejected.
I was looking into other info also about I-765 filing. The instruction is too old for students (Foreign Students). Most of the information is given for them in http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=73ddd59cb7a5d010VgnVCM10000048f3d6a1RCR D&vgnextchannel=db029c7755cb9010VgnVCM10000045f3d6a1 RCRD

None of the bills for CIR state that the illegals will be able to file for GC right away. They will have to wait for atleast 8 years from the date the bill is passed, as per the latest Hagel Martinez version.

Would you please elaborate if the flower campaign has hit any mainstream media like CNN, Fox etc?? Or just the TOI and other small covers? I just want to know how famous this has become.. Thanks.
The flower campaign is apparently working as far as the attention the issue is getting.
If we can manage to send at least 500-700 flowers to USCIS, that will create the kind of attention we want and it will bring the issue of retrogression again on the forefront in Washington DC.
PLEASE PLEASE send the flowers to USCIS director Emilio Gonzalez. For details on sending, address and the message on the message card, read this thread :

If they state their reasoning behind these processing times and let us know in writing that only apps with current priority dates are being considered, that will put to rest a lot of our anxiety.
As much as I am anxious to know about the application being approved, the lack of transparency is what frustrates me the most. They create the rules and they bend it as and when it suits them.
I wish they would only state the true state of affairs.

I think your plan may work out just fine. I would make a couple of suggestions:
1. If you are taking LOA from original employer, for practical purposes (for USCIS), you are not employed with that employer any more (they go by pay stubs). But if doing so helps to avoid revocation of 140, go ahead and do it that way.
2. Because you will actually get your pay check from new employer, you are employed by them (and you will work on EAD with them, make sure that this is mentioned on your I-9 form). No matter how much ignorant your employer is, they will have to have I-9 on file and it must have your EAD (not H1).
3. After doing this, you will be on I 485 pending status (no longer on H status), and so make sure you have current EAD and AP all the time.
4. If something goes wrong with your I 485 (very unlikely); you will have to leave the country and enter back on H visa and work for H visa sponsoring employer (probably your old employer).
5. It is perfectly fine to not file AC21. AC21 is needed only if you do not plan to join original sponsoring employer after GC approval. However, if you do want to file AC21, you do not need much documentation from your new employer. It just needs the simple letter stating your job position as a "physician" and brief job duties (briefer the better!) and salary (should be proportional or higher). If you do not file AC21, you may just keep that documentation on file with your attorney (which I would do to be on safe side). The implication of having this is as follows:
--If you have this documentation (even if not filed with USCIS), at the time of approval of your GC you will have the option of just staying with new employer or going back to original employer.
--If you do not have this, you will have to go back to original employer after GC approval with a "good faith intention of permanent job".
PM me if you have questions about what I said above, and I will be happy to talk to you.
Good Luck.
very helpful reply..I guess i will go ahead and take the plunge next year ...who knows if the stars are right we may all be greened soooooon.!

Folks, just a hunch but I don't think the bulk of the Dems are against Cornyn's amendment. I think the Dems will trade support for this provision in return for the repubs supporting the AgJobs bill if and when it comes to the Senate floor. No point in giving away a barter chip for nothing.

these movements are not really worth anything.. it has to overcome that resistance
..
Dude, these are not stocks where resistance and support play parts, it is USCIS/DoS. All they offer: resistance from with-in with no support to its customers. I am surprised you are still trying to find a pattern/curve. At best, it can be represented by a squiggly line my nephew draws..

I am on H4 for past 2yrs. My H1 is valid since Oct07. I want to travel to India in Dec this yr. I have few questions:
1. I haven't started to work. So, what is my status as of now, after my H1 being aproved and valid since Oct1 2007?
2. My H4 is valid till Mar 2008. If I want to travel to India in Nov end and come back in Dec, do I need stamping on my H1 from the consulate.
If YES then:
Do I need to show any pay-stubs?
I NO then:
a. At the port of entry what status is I am supposed to declare?
b. If I enter as an H4 then does that invalidate my H1 visa?
Plz help!!

Why are we discussing this subject when it will do nothing to take us closer to getting the GC? In almost each social event, I have heard this subject being talked by my fellow friends. But discussing it on IV forum does not serve much purpose.
To me, it seems in the conversations about this subject (not just this thread, even in social events), each person is trying to find a group of people that agree to his or her thoughts. That makes the group then feel better. But what do we all do the next day, pray that we get the GC fast. People who want to really go back to their country do not take much part in these discussions. They just pack up and go.
If we are spending any time on IV, it should be focussed on our effort to get the GC. Or to help someone of us facing an immigration related issue.

for reply.... as I said I am on EAD.....
assuming you are serious about the house ..I can say this ..with your PD and category it makes more sense to rent a house for a year and then decide yourself.
with a house you get lot of space, independence but with significantly high costs, maintenance and loss of mobility. plus you end up buying far away from your work ..so family time is lost during weekdays.
in apartments - you end up saving and investing more in retirement accounts, children education accounts etc etc ..but the flexibility is priceless...also greater chance of your kids making more friends in apartment parks / play dates etc.
so renting a house is a good bet if you really really need space ....home prices will decline for many more months in most locations and will be stagnant for years when u take inflation into account ..

Hey Guys,
This EAD thing is really annoying, my wife got her AP and EAD last 11/21, with immediate update in USCIS.gov. I'm still waiting for mine, and I'm the principal. Anyway. I'll have an infopass appointment on 12/18. My H1-B permit expires on 02/07/08.
We applied to NSC, all documents received on August 02/2007.
