The price of GC is what you assign to it. The value of GC is not what other people tell you it is. If you get depressed, make your life hell - it's because you chose it. My PD is 2010 in EB2 and I came here in 2004. I know what I'm getting into and it's my decision so I won't fret about it or get depressed. GC is just a document, it should not define you or your life.
Enjoy time with your Family, wife, kids - it's priceless.....a new sports car will also help. Life is a great gift and will have ups and downs....don't let GC define who you are. I rejected filing in EB3 3 years back with a big 4 consulting firm and changed jobs. I also feel this "promotion" thing but I chose to be in that position. My friends in India are all PM's and Sr PM's.....they got what they chose.

Its very easy to preach 'Life is decided by choices we make', 'your luck/fate, success is decided by your own effort, talent', 'if you have it, ppl will notice it and you will succeed' etc. when you spend the most energetic, productive part of your life in a country, you would expect that country reward you with atleast opportunities to prove your mettle. not to say its immensely painful when ppl who came years and years after you get GC and grow leaps and bounds right in front of your eyes.
P.S. I am not questioning your qualifications or anything.

Hope you all are doing well.
I will join you folks. I was there at San Jose rally, DC rally and advocacy event, will be there this year. Good to see some of the returning folks. Last time California had more than forty members at the DC rally, probably the reflection of the state of economy and urgent need for immigration reform at that time. Time have changed and many people's circumstances have changed but our resolve is unchanged. Last time our advocacy effort impacted the lives of hundred of thousands of people who were able to apply for their EAD. Sweet victory for IV members and hats off to their leadership in this area.
Now, we work to help gather support for a CIR bill. I am excited about this. Lets do this.

I am very sorry. I know exactly what you have been through. My wife also experienced a very complicated pregnancy. My baby *nearly* was born prematurily. Then Thanks God that did not happen. I felt all the pain because my wife was kept flat on bed rest for 4 months.
To make things more complicated, the doctors made an apparent mistake and mixed two type of incompatible medicines which made her develop fluids in her lungs. She was transferred to another hospital, in which a young doctor, an intern, believed she had developed a blood clot on her lung ! She was submitted to several exams to determine that was not a blood clot.
The bill for all that ? $40,000+. If I had to pay that on my own, I would be in bad shape.
In this country is dog eat dog, rat eat rat. It is about money. I am still happier here than in Canada though. That varies from individual to individual though.

My PD-Oct 2001..Eb3..My wife RIR-almost making it thru I140when all hell broke loose in our lives...my wife was pregnant and because of stupid gynaecologist..she ended up in hospital with complicated premature preganancy..guess what..as if it was not bad enough..her company got acquired just when she was admitted in hospital...imagine wondering about health insurance when she was kept to bed rest with no mobility allowed..we filed for insurance by mistake..which said that 20% in patient.....we were so shaken that even human resource did not advise us..guess what..baby was born..and it was surmised that baby will have long stay in hosiptal...2-3 months(eventually it was 4 months!)..somwhere around the first month..I realized that her insurance..will rip me off..I called right at the end of the first month..and tried several times to put my wife and baby on my insurance so that i don't end up paying 20%..it was lot of efforts until I found some desi in Blue cross insurance who put the whole family from the first initial month..when normally people get the policy for the following month at that time.
one down --and then another came..my wife was called to her office from hospital saying that..since there was lot of work in her office..she could come for some days..guess what..she went back..thinking..she could finish work and then take extended leave....guess what..she was laid off..and with baby in hospital..and lay off..plus a rush to change her status to H4 visa..imagine the workload.....finally got her status changed..to h4 visa..with GC and labor in trash...

So basically, an unlawfull alien residing in US for past 5 years gets change his status to PR, moreover he is not restricted by the per country limit he can go from filing I-485 to get a Visa number allotted to him practically overnight..and not having to wait like folks from India or China ....
I dont think this bills has anything favourable to legal immigrants... It better to apply as the other category ....

I have confirmed my travel plan. I will attend all events on Jun 6, 7 and 8. I have already paid for my airfare. I can bear all the local trasportation and incidental expenses. I don't have a place to stay, though. I would appreciate if someone can sponsor a 3 night hotel stay for me in Washington DC.

Remember, 245i cases were the NOT the same as the mexican illegal aliens that are being spoken of in relation to CIR .. lots of educated, legal H1-Bs lost their jobs (and their legal status) during the dot com burst of 2000 - 2002. Some of them stayed on even after going out of status, and then became eligible to file for GC under 245i.And needless to say, many more of those H1s came from India than mexico.
Any clarifications why India EB3 is behind mexico?
1. May be there are more Indians in 245(i) cases than mexicans.
2. May be lots of Indians have applied 245(i) cases eventhough they are not illegal. I heard that this is possible and you can use this to any future employer.

After doing all this "very important" discussion about Rs/$ conversion, if you get sometime, please read some news about immigration bill to find out that there is lot of activity going on with the immigration bill. Most of the time anti-immigrats are calling and putting pressure on lawmakers who support any sort of immigration bill. That is why McCain, Brownback and many others backed out. Anti-immigrants are working overytime making it look like as if their opinion is the opinion of the entire nation. Each person is making 20-30 phone calls a week. But it is ok if none of us is doing anything. Lets all "time pass" and have this very important discussion about Rs/$ eachange rate variation... right?
Communities/groups/societies who do not understand the need to organize and standup for themselves always perish. Durbin-Grassley bill is just the beginning of the time for this high skilled immigrant community to disappear. Reason - When any group of people increases in number there is always another group which becomes its natural opponent/adversary. This community of over a million people also have very powerful opponent/adversary. That opponent is gaining strength and working overtime to purge all of us. But that is ok, let us talk about Rs/$ conversion rate. Anybody here from Uruguay or Morocco??? Why don’t people from Uruguay or Morocco and all other countries of the world join us in this VERY VERY important discussion about the recent exchange rate variation of Indian Rs/$. This is a sheer tactics with no substance at all. Realistically that situation won't arise in a single lifetime considering this current immigration environment :) To get the GC is ~10 years and then citizenship is another 5 years and then applying and getting family immigration is another ~10-15 years (if not more) by that time the applicant's (adult) parents won't survive anyway, if not the initial applicant himself!!

Many here are 'strongly against' those 'horrible' desi or whatever companies after getting an h1b through them. As we know most of the software consultants are here only because those companies could utlize the loopholes in the system. (We all know that this labor certification and such things are nonsense!). It is great to fight for 'legal' things but when you see those who misusd it themselves are 'fighting' for it, makes people feel so funny! We all know that what we all need is GC, whatever be the way, and whatever happens to 'others'. It is legitimate and understandable to fight for 'our cause', otherwise who will fight for us?
[According to me nothing is 'wrong' to be here using any method even being an 'illegal immigant', but fortunately I am here in USA 'legally' and not using 'desi' or such companies]

i really appreciate and applaud what you and other members of immigration voice and other pro-imigration groups have done but for personal reasons i believe that fighting the congress is a losing battle and i sincerely doubt if we'll have any pro-immigration bill passed before the 2008 presidential election and when the new president comes this will fall att the bottom of his/her agenda. Look at Bush's tenure he's promised pro-immigration measures since 2004 and squat has happened. The issue is that there a lot of anti- legal and illegal immigration activists and congress members who will make sure nothing goes thru the senate or the house.

I would like to know if a person who has H1 valid until jan 1, 2009, files for AOS on oct 5, 2008 and then goes out of the country in Dec 08 and get paroled into the U.S as "AOS" in his/her I-94, using AP. What happens to this person...is he/she still deportable even though that person is now officially on AOS.

Who said the position must be in zone V only to qualify for EB2?
For the position to be qualified for EB2 it must require MS. For position requirements to be considered "normal", they must fit into the respective zone in terms of SVP level. As I learned from my bitter experience, though offficially for a PERM to be approved the requirements don't have to be "normal" (if they are not, you just need to supply the "business neccessity" letter), it looks like the current PERM's software just doesn't have such possibility "in mind" and automatically denies the application if the total education plus experience requirements exceed the SVP level for the zone corresponding to the position. You will get a denial notice which will blatantly claim something like "By answering YES to question H-12 you have attested that the requirements are normal, but the total SVP level exceeds the normal level for this position..." even if you have answered NO to that damn question! Therefore I don't recommend to exceed "normal" SVP level for the corresponding position code.
However, if a suitable code falls under zone IV, nobody (except for emplyer himself maybe) can prevent the employer to require, say, MS plus 2 yrs of experience. And it is within "normal" SVP level for zone IV, and it does qualify for EB2 (because it requires MS).
