    You've worked all your life to get something decent back. Went to decent schools, worked hard in your 10th and 12th grade, earned your bachelors. Now what?

    Go there. Read the mission of the org. Its non-profit. Its free to join/volunteer and contribute your thoughts. See if its something you can relate to. If you feel comfortable and can trust, then contribute money. If not then you can still post on threads and forums and contribute your thoughts and give ideas. It still beats sitting and doing nothing about something that hurts us so much. After all that you have been thru, why stop now and sulk? Why not act?

    I respectfully disagree, he is the president of USA and to its citizens, you might morally/personally declare him to be your president, but as long as your passport is not from USA you my friend are an alien (not extraterrestrial) living in the US of A :), please dont take this personally I am in the US too, and I got my passport recently renewed, and I had to pledge my allegiance in order to get my passport.     Must an H-1B alien be working at all times?

    As long as the employer/employee relationship exists, an H-1B alien is still in status. An H-1B alien may work in full or part-time employment and remain in status. An H-1B alien may also be on vacation, sick/maternity/paternity leave, on strike, or otherwise inactive without affecting his or her status.

    No, but he must be an employee. H-1 employee can avail vacation, sick days off, unpaid vacation days as are available to ALL OTHER employees. Employer needs to document such policies. There are complex issues involved here.

    Like you said in post As long as the employer/employee relationship exists this is the key part. How to prove employee relation - mostly by pay stubs and employment letter. Also, I-9 Form date determines when employee really reported to start the employment.

    i am getting frustrated to see the bulletin everymonth and it never moves.
    people applied in 2006 got their GCs. one of collegue ROW got when applied in 2007.

    dont know whom to blame. why cant they understand our problems.
    r they least bothered.

    Yes, I used nycgal's and made little modification to the intro part. Picked up the IV intro from our home page. Also emphasized on the skilled-immigrants rather than just legal immigrants. Still need to send it to Mr.Sturgeon.

    The very reason why we join this forum so that we can, as whole, say something that may influence the law makers of this country to change the existing laws so that our problem with GC will be resolve.

    Alot of times the comments in this forum are completely irrelevant and very insulting to the Americans. And here, we are asking them to please change your laws so we could live happily in their county. And if they say no, that's their right.

    I am as frustrated as anyone here and I know people from other countries including Australia, Philippines, UK and China who have been waiting for years as well.

    If we could please make our comments "not country-centric", I am sure more people will join this forum.

    I know several people are not participating in this forum anymore because they are turned off by these country-centric comments.

    It hurts, but that's the truth.

    you should possibly also carry a copy of the AP application. At least my application clearly stated that travel was for business/personal reasons...

    I am sorry you had a bad experience...possibly because of the officer's ignorance...worth a complaint...maybe you can draft something with your lawyer....don't just ignore such bad behavior...

    I have travelled on AP and didn't have any problems..although the officer stamped a wrong date (one day earlier) on my passport..talk about incompetence

    No vkkkk, I'm not playing. What some people are saying is logic and what i'm saying is the fact. You seems new in this form. But i think most of the people here are serious and try share their sufferings, free help from freinds (virtual).

    Anyway, My lawyer used the PERM. right after i received my Labor (may 2006) I had to renew my H1b which took 6 months (regular processing). After i received my renewal I sent my I-140 application. I didn't even bother to use the premium processing for my i140 because the i485 was not current that time, instead it way way back as a EB3. anyway, you know the rest of the story.....

    I-140 Applied Feb 8, 2007 (Approved Sep 18, 2007)
    I-485 Applied Jun 29,2007...Received Receipt on July 31, 2007
    Status - Pending

    currently 140 processing dates around Nov/dec-06.

    You can subscribe to CRIS email for status updates. But sometimes you may not get the email. The letter may directly go to your ex employer's Attorney.

    Even if you get a NOID, it may go to your ex employer's Attorney. We all know this employer attorney nexus - they are ready to screw you.

    Hi,

    My EAD renewal was filed in TSC in the middle of June. Now it is more than 2 months I haven't heard anything from them. I wonder do they request for FP during EAD renewal ? When I applied for EAD first time in 2007 there was no request for FP and the EAD was approved without FP. But I have seen several posts where folks mentioned that they have got FP notification after they filed their EAD renewal. I have done one FP beginning of 2008 as part of my AOS filed on July 2, 2007. So, I wonder do I receive another FP notification as part of my EAD renewal or USCIS can use my existing FP (they may have in their system) ?

    Thanks for all the inputs. I still have not received the letter ( probably because of winter strom - delay with traffic) .

    Now if the Deniel is because of AC21 and 140 revoke , when we reply with MTR, should I sent copy of the AC21 letter we sent before or do we need to sent a fresh one ( employment verification letter ) ? The reason I ask this is when we originaly filed AC21 docs ( in Feb 2008) I was with Company2 . Now I am with company 3 ( just 2 months ). And good part of is company3 is well aware about the "same or similar " letter and is ready to issue the letter .

    What are the conditions required for processing the 485 application.

    1. Are all applications which have a 485 RD within the processing date, are processed? or
    2. Only applications which have a RD within the processing date and whose PD is current, are processed.


    As per the uscis approvals it was all happening randomly,,sometimes they stick with rules and sometimes not..ofcourse PD should be current but ProcessingDates vs 485 RD its still stands a mystery.
